1Name of regulation

This regulation is the Australian Human Rights Commission Amendment (Grounds of Discrimination) Regulation 2013.

2Commencement

Each provision of this regulation specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

2.  Schedule 1

The later of:

(a) the day after this regulation is registered; and

(b) the day on which Schedule 1 to the Sex Discrimination Amendment (Sexual Orientation, Gender Identity and Intersex Status) Act 2013 commences.

However, the provision(s) do not commence at all if the event mentioned in paragraph (b) does not occur.

3Authority

This regulation is made under the Australian Human Rights Commission Act 1986.

4Schedule(s)

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Australian Human Rights Commission Regulations 1989

1  Regulation 3

Insert:

marital or relationship status has the same meaning as in the Sex Discrimination Act 1984.

2  Regulation 3 (definition of marital status)

Repeal the definition.

3  Subparagraph 4(a)(v)

Omit “marital status”, substitute “marital or relationship status”.

4  Subparagraph 4(a)(ix)

Omit “sexual preference”, substitute “sexual orientation”.

5  At the end of the regulations

Add:

5  Application of amendments made by the Australian Human Rights Commission Amendment (Grounds of Discrimination) Regulation 2013

                 The amendments of these Regulations made by the Australian Human Rights Commission Amendment (Grounds of Discrimination) Regulation 2013 apply in relation to the performance by the Commission of its functions under Division 4 of Part II of the Act in relation to:

                   (a)  acts or practices engaged in wholly after the commencement of Schedule 1 to that regulation; and

                   (b)  acts or practices engaged in partly before and partly after that commencement.
