Alteration of other rules of organisation.

1. On 2 June 2017, the South Australian Branch of the Australian Hotels Association (the Branch) lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to the rules of the South Australian Branch of the Australian Hotels Association (the Branch Rules).

1. The particulars set out alterations to rules 6, 7, 14, 15, 16, 20, 23, 30, 31, 32, 34 and 37 of the Branch Rules.

1. On 27 July 2017, the Branch provided confirmation that a notice had been published on the web site of the Branch in accordance with regulation 126(1)(c) of the Fair Work (Registered Organisations) Regulations 2009.

1. The declaration of Mr Richard Lovell contained within the notice of particulars provides that the alterations were made during the Annual General Meeting of the Branch held on 1 May 2017 (the AGM). In his further correspondence of 30 August 2017, Mr Lovell confirms that:

·  Notice of the AGM was given in accordance with rule 14(b) of the Branch Rules; and

·  The alterations were included in the requisite Business Sheet for the AGM in accordance with rule 14(c) of the Branch Rules.

1. On the information contained in the notice and the further correspondence of Mr Lovell of 30 August 2017, I am satisfied the alterations have been made under the rules of the organisation.

1. In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
