| DECISION |
Fair Work (Registered Organisations) Act 2009
s.159—Alteration of other rules of organisation
Australian Higher Education Industrial Association
(R2017/101)
| MURRAY FURLONG | MELBOURNE, 13 september 2017 |
Alteration of other rules of organisation.
On 2 June 2017 the Australian Higher Education Industrial Association (AHEIA) lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to its rules.
The particulars set out alterations to rules 2; 13; 22 and 32 in order to allow for representation of members by proxy at general meetings.
On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.
Further information concerning compliance with Regulation 126 of the Fair Work (Registered Organisations) Regulations 2009 (the regulations) was provided on 10 July 2017.
Regulation 126(1)(b) requires that the organisation publish a notice on its website within 35 days of the alterations being made that the alterations have been lodged with the Commission. The regulation also provides me with the discretion to allow any additional period for the publication of the notice. The granting of an additional period is not as of right. I allow an additional period for lodgement in this instance. However, I remind the AHEIA that it is incumbent on registered organisations to comply with the obligations set down in the Fair Work (Registered Organisations) Act 2009 (the Act) and the regulations and I expect them to do so in future.
In my opinion, the alterations comply with and are not contrary to the Act, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Act.
