I, PHILIP MICHAEL JEFFERY, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the
Australian Heritage Council Act 2003 .Dated 18 December 2003

These Regulations are the
Australian Heritage Council Regulations 2003 .
These Regulations commence on 1 January 2004.
In these Regulations:
Act means theAustralian Heritage Council Act 2003 .
For paragraph 21 (2) (a) of the Act:
(a) if the Council proposes to include a place in, or remove a place from, the Register, it must:
(i) inform the appropriate authority of the State or Territory government and the local government (if any) of all or part of the place about the proposal; and
(ii) give the authority a reasonable opportunity to comment on the proposal; and
(b) if the Council includes a place in, or removes a place from, the Register, it must inform the appropriate authority of the State or Territory government and the local government (if any) of all or part of the place about the decision.
(1) For paragraph 21 (2) (b) of the Act, the Register must contain:
(a) a description of each place that is entered in the Register; and
(b) the date on which the entry is made in the Register.
(2) For paragraph 21 (2) (c) of the Act, the Register may be kept by means of a computer.
(3) For paragraph 21 (2) (d) of the Act, the Council must publish the Register on the Internet in a way that ensures that, if a place is of a kind that may suffer damage if its location is disclosed, the location of the place is not disclosed.
