PART I—PRELIMINARY
1. These regulations may be cited as the
Australian Formula One Grand Prix Act
2. These regulations shall come into operation on 3 October, 1985.
3. These regulations are arranged as follows:

4. (1) In these regulations, unless the contrary intention appears—
"the Act" means the
Australian Formula One Grand Prix Act, 1984 :"approved" means approved by the Board:
"authorized person" means a person appointed by the Board to be an authorized person for
the purposes of these regulations and includes a member of the police force of the State:
"emergency vehicle" includes an ambulance, fire engine, police vehicle, tow truck or mobile
crane:
"entrance" includes a gate or turnstile:
"exit" includes a gate or turnstile:
"grand prix circuit" means the motor racing circuit established by the Board under the Act:
"imitation ticket" means a document that a person passes off, or attempts to pass off, as a
ticket or a document that resembles a ticket and could reasonably be taken to be a ticket:
"invitee" of a resident includes an employee, agent, or licensee of the resident:
"permitted entrant" means—
a person who is entitled to be in the declared area in pursuance of a ticket or permit issued by or on behalf of the Board; | |
a person who is admitted to the declared area by an agent of the Board on payment of an admission fee; | |
an agent or employee of the Board; | |
a resident or an invitee of a resident; | |
or | |
any other person who is, in pursuance of a general or specific authorization granted by the Board, entitled to be in the declared area: |
"racing car" means a vehicle that is entered in the Australian Formula One Grand Prix or any motor racing event that is to be held on the grand prix circuit in association with the Australian Formula One Grand Prix:
"resident" means a person who has a permanent place of residence or business in the
declared area:
"ticket" means any ticket, pass of other document, issued by or on behalf of the Board,
conferring a right to enter the declared area.
PART II—AUTHORIZED PERSONS
5. (1) The Board may appoint persons to be authorized persons for the purposes of these
regulations.
(2) Every member of the police force of the State is an authorized person.
6. (1) Subject to subregulation (2) the Board shall issue an identity card to every authorized
person.
(2) An identity card need not be issued to an authorized person who is a member of the
police force.
(3) An authorized person (not being a uniformed member of the police force) shall, on demand by any person in relation to whom the authorized person is exercising or proposing to exercise any power under these regulations, produce for the inspection of that person—
the identity card issue under this regulation; | |
or | |
if the authorized officer is a member of the police force—the member’s warrant card. |
7. An authorized person may use such reasonable force as is necessary for the effective exercise of powers or functions conferred on, or assigned to, the authorized person by these regulations.
PART III—ACCESS TO THE DECLARED AREA
8. (1) No person other than a permitted entrant shall enter the declared area.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
9. (1) No person shall enter the declared area except through an approved entrance.
(2) No person shall leave the declared area except through an approved exit.
(3) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
10. An authorized person may—
prevent any person who is not entitled to enter the declared area from entering the declared area; | |
prevent any person from entering the declared area otherwise than through an approved entrance; | |
prevent any person from leaving the declared area otherwise than through an approved exit; | |
remove from the declared area any person who has unlawfully entered the declared area; | |
request any person in the declared area to produce a ticket or other satisfactory evidence of that person’s entitlement to be in the declared area; | |
remove a person from the declared area who fails to produce satisfactory evidence of that person’s entitlement to be in the declared area; | |
remove from the declared area any person found committing an offence against these regulations or whom the authorized person reasonably suspects of having committed or being about to commit an offence against these regulations. |
11. (1) A person who has been removed from the declared area by an authorized person, shall not re-enter the declared area on the same day.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
12. (1) No person except—
the driver or other occupant of— | ||||||||

a person specifically authorized by the Board to enter the grand prix circuit, |
shall be on the grand prix circuit.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
13. A person shall not bring a vehicle into the declared area except in pursuance of a permit or other authorization issued or conferred by the Board.
Penalty: | $1 000. |
14. (1) A resident or an invitee of a resident is entitled to such access to the declared area as is necessary for or incidental to—
the ordinary use or enjoyment of the resident’s place of residence or business in the declared area; | |
or | |
travelling to or from that place of residence. |
(2) If a resident or an invitee of a resident is in the declared area otherwise than in pursuance of the entitlement referred to in subregulation (1) or some other entitlement conferred by the Board the resident or invitee shall not be regarded as a permitted entrant.

PART IV—TICKETS AND PERMITS
16. (1) The Board shall by notice in the
(2) Subject to any express term of the ticket or permit to the contrary, a ticket or permit does not confer a right to be in the declared area before the opening time or after the closing time on any day.
17. (1) No person shall sell or offer for sale any ticket at a price greater than that fixed by
the Board.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
18. (1) No person shall sell an imitation ticket.
(2) Any person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
19. (1) An authorized person may confiscate an imitation ticket.
(2) An authorized person may require a person who has possession of an imitation ticket to produce it for confiscation.
(3) A person who fails to comply with a requirement under subregulation (2) is guilty of an offence and liable to a penalty not exceeding $1 000.
20. A ticket marked "non-transferable" does not entitle any person except the person named or identified in the ticket to enter the declared area.
21. (1) The Board may set aside—
certain areas within the declared area as reserved areas; | |
certain blocks of seats within the declared area as reserved blocks of seats; | |
and | |
certain seats within the declared area as reserved seats. |
(2) The Board may issue tickets that entitle the ticket holder to—
enter and remain in a reserved area; | |
occupy a seat in a reserved block of seats; | |
or | |
occupy a reserved seat. |
(3) Reserved areas, reserved blocks of seats and reserved seats must be clearly differentiated by signs or markings.
22. (1) No person except the holder of a ticket conferring an entitlement to enter the reserved area shall enter or remain in a reserved area.
(2) No person except the holder of a ticket conferring an entitlement to occupy a seat in a reserved block of seats shall occupy a seat in a reserved block of seats.
(2a) No person except the holder of a ticket conferring an entitlement to occupy that particular seat shall occupy a reserved seat.
(3) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
(4) An authorized person may remove any person from—
a reserved area; | |
a seat in a reserved block of seats; | |
or | |
a reserved seat, |
if that person, on request by the authorized person, does not produce an appropriate ticket entitling the holder to enter and remain in the reserved area, occupy a seat in the reserved block of seats or occupy the reserved seat.
23. (1) The rights conferred by a ticket or permit are subject to conditions and limitations—
stated or referred to in the ticket or permit; | |

imposed by the Board and published in the |
(2) A person shall not contravene or fail to comply with the conditions or limitations to which the rights conferred by a ticket or permit are subject.
Penalty: | $1 000. |
PART V—ALCOHOLIC BEVERAGES
24. (1) Subject to subregulation (2) no person shall bring any alcoholic beverage into the
declared area.
(2) This regulation does not apply to—
any person who— | ||

(3) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
25. (1) An authorized person may request any person who is in possession of an alcoholic beverage that has been brought into the declared area in breach of these regulations to surrender the beverage.
(2) A person who fails to comply with a request under subregulation (1) is guilty of an offence and liable to a penalty not exceeding $1 000.
(3) Where an alcoholic beverage is not surrendered in compliance with a request made under subregulation (1) an authorized person may confiscate the alcoholic beverage.
26. (1) No person shall bring into the declared area any ice box, can or bottle without the prior written consent of the Board.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty
exceeding $1 000.
(3) An authorized person may seize and confiscate any ice box, can or bottle that has been brought into the declared area in contravention of subregulation (1).
27. (1) An authorized person may request any person who is about to enter the declared area to allow an authorized person to inspect any bag, basket or other receptacle that the person intends to take into the declared area.
(2) A person to whom a request under subregulation (1) is made shall not enter the declared area before complying with such request.
(3) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
28. (1) No person shall consume within the declared area any alcoholic beverage that has been brought into the declared area in contravention of these regulations.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
29. (1) The Board may set aside certain parts of the declared area for use as refreshment
areas.
(2) The Board may designate each such refreshment area by appropriate markings.

(4) The Board may post at or near any exit from a refreshment area a notice bearing the words "NO BOTTLE OR CAN MAY BE REMOVED FROM THIS AREA".
30. (1) No person shall remove from a refreshment area any bottle, can or glass that has been obtained within that area in contravention of a notice posted by the Board prohibiting the removal of the bottle, can or glass from that area.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
(3) An authorized person may seize any bottle, can, or glass that has been removed from a refreshment area in contravention of subregulation (1).
PART VI—CONDUCT OF PERSONS WITHIN THE DECLARED AREA
31. (1) No person shall, without the consent of the owner, damage, deface or destroy property of another within the declared area.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
32. (1) No person shall pick any flower or injure or uproot any tree, shrub, flower or other plant within the declared area.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
33. (1) No person shall, without the prior written consent of the Board, post, stick or place any poster, placard, bill, banner, advertisement, print or paper on any building, structure or fence that is within the declared area.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
(3) An authorized person may remove and confiscate any poster, placard, bill, banner, advertisement, print or paper that has been stuck or placed on any building, structure or fence in contravention of this regulation.
34. (1) No person shall, without the prior written consent of the Board, distribute printed matter within the declared area.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
(3) An authorized person may confiscate any printed matter distributed in contravention of
this regulation.
35. (1) No person shall deface any building or structure within the declared area.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
36. (1) No person shall—
erect any structure within the declared area; | |
or | |
bring into the declared area anything that could be used for the erection of a structure, |
without the prior written consent of the Board.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
(3) An authorized person may—
confiscate materials that are brought into the declared area for the purpose of erecting a structure in contravention of this regulation; | |
or | |
dismantle any structure that has been erected within the declared area in contravention of this regulation. |
37. (1) No person shall sell or offer for sale anything within the declared area without the written consent of the Board.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
(3) An authorized officer may confiscate anything sold or reasonably suspected of being offered for sale in contravention of subregulation (1).
38. (1) No person shall bring into the declared area any animal or bird without the written consent of the Board.
(2) A person who contravenes or fails to comply with this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
(3) An authorized person may remove from the declared area any animal or bird that is brought into the declared area in contravention of this regulation.
39. (1) Where the Board considers that it would be unsafe to allow persons generally to enter or remain in a particular part of the declared area it may designate that part of the declared area as a restricted area.
(2) The Board may designate a restricted area by appropriate markings and must post at or near the entrance of a restricted area a notice bearing the words "RESTRICTED AREA: ACCESS TO PERMITTED PERSONS ONLY".
(3) No person shall enter or remain in a restricted area without the prior consent of the
Board.
(4) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
(5) An authorized person may remove any person from a restricted area if the authorized person has reasonable cause to believe that that person does not have the prior consent of the Board to enter or remain in the restricted area.
40. (1) Where the Board considers that it would be unsafe to permit smoking in a part of the declared area it may designate that part of the declared area as a no smoking area.
(2) The Board must designate a no smoking area by appropriate markings and must post at or near to the entrance to the no smoking area a notice bearing the words "NO SMOKING".
(3) A person who smokes in a no smoking area is guilty of an offence and liable to a penalty not exceeding $1 000.
41. (1) No person shall within the declared area—
climb on or remain on— | ||||
| ||||
misuse any seat or structure; | ||||
block any thoroughfare including any stair, steps, aisle, gangway or passage; | ||||
deposit litter, except in a receptacle provided for that purpose; | ||||
throw any stone, bottle or other missile; | ||||
light or maintain a fire; | ||||
discharge a firearm; | ||||
or | ||||
behave in a manner that may interfere with the comfort of persons within the declared area. |
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
42. (1) The Board may grant a licence to a person to conduct an entertainment for members of the public in the declared area.
(2) A licence may be grant under this regulation on such conditions as the Board thinks fit.
(3) The Board may, by notice in the

conduct an entertainment on the declared area without being licensed to do so under this regulation; | |
if licensed to conduct an entertainment—contravene or fail to comply with a condition of the licence; or | |
contravene or fail to comply with a condition imposed under subregulation (3). |
Penalty: | $1 000. |
(5) An authorized person may remove from the declared area a person reasonably suspected of having committed an offence against subregulation (4)
43. (1) No person shall—
use indecent or obscene language; | |
use threatening or insulting words; | |
behave in a threatening, abusive or insulting manner; | |
behave in a riotous or indecent manner; | |
urinate or defecate otherwise than in a building or structure specifically provided for the purpose, |
in the declared area.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty
of $1 000.
(3) An authorized person may remove a person from the declared area who contravenes this
regulation.
PART VII—EXPIATION OF OFFENCES
44. Pursuant to section 30 of the Act the amount fixed for the purposes of subsection (4) is
$50.
PART VIII—MISCELLANEOUS
45. Parts III, IV, V and VI of these regulations apply only during the declared period.
46. Where an authorized person confiscates anything under these regulations the Board shall, if written application for its return is made by the owner before the expiration of one month from the end of the declared period, return it to the owner but otherwise the Board may dispose of it as the Board thinks fit.
47. (1) No person shall interfere with, obstruct or hinder an authorized person in the exercise of powers, functions or duties under these regulations.
(2) A person who contravenes this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
48. (1) If an authorized person has reasonable grounds to suspect that a person has committed an offence against these regulations the authorized person may require that person to state his or her full name and address and if the authorized person has reasonable cause to suspect that the name or address stated is false, he may require that person to produce evidence of the correctness of the name or address so stated.
(2) If any such person refuses to comply with a requirement of an authorized person under subregulation (1), or states to an authorized person a name or address that is false or produces to an authorized person false evidence in relation to his or her name or address, he or she is guilty of an offence and liable to a penalty not exceeding $1 000.
49. (1) Where an authorized person considers that a dangerous or potentially dangerous situation exists within the declared area the authorized person may request any person forthwith to vacate the declared area or any part of the declared area.
(2) A person to whom a request is made under subregulation (1) shall comply with that
request forthwith.
(3) A person who contravenes or fails to comply with this regulation is guilty of an offence and liable to a penalty not exceeding $1 000.
