Australian Federal Police Regulations2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Australian Federal Police Act 1979.

Interpretation

 1. Regulation 2 of the Australian Federal Police Regulations is amended by omitting the definition of “association” and substituting the following definition:

“ ‘association’ means the association of members formed in accordance with Part IV;”.

Constitution of Board

 2. Regulation 20 of the Australian Federal Police Regulations is amended—

• (a)

  by omitting paragraph (1) (d) and substituting the following paragraph:

  • “(d)

    36 persons nominated in accordance with the rules of the association.”;

• (b)

  by omitting paragraph (4) (c) and substituting the following paragraph:

  • “(c)

    a person referred to in paragraph (1) (d).”; and

• (c)

  by omitting sub-regulation (5).

Termination of appointment

 3. Regulation 23A of the Australian Federal Police Regulations is amended—

• (a)

  by omitting from sub-regulation (1) “an association” and substituting “the association”; and

• (b)

  by omitting from sub-regulation (2) “an association” and substituting “the association”.

Appeal against selection for promotion

 4. Regulation 26 of the Australian Federal Police Regulations is amended by omitting sub-regulation (3).

Heading to Part IV

 5. The heading to Part IV of the Australian Federal Police Regulations is omitted and the following heading substituted:

“PART IV—ASSOCIATION”

Members may form association

6. Regulation 35 of the Australian Federal Police Regulations is amended by omitting “not more than two associations” and substituting “one association”.

Repeal of regulation 36

 7. Regulation 36 of the Australian Federal Police Regulations is repealed.

 8. Regulation 37 of the Australian Federal Police Regulations is repealed and the following regulation substituted:

Name of association

“37.

The association shall not use an appellation that does not include the words ‘Australian Federal Police Association’.”.

Rules of association

 9. Regulation 38 of the Australian Federal Police Regulations is amended—

• (a)

  by omitting “an association” and substituting “the association”;

• (b)

  by adding at the end of paragraph (a) “and”; and

• (c)

  by omitting paragraphs (b) and (c) and substituting the following paragraph:

  • “(b)

    for and in relation to the nomination from time to time of persons for appointment to the Promotion Appeals Board.”.
