the Federal Executive Council, make the following Regulations under the
1992.

1.1 The Australian Federal Police Regulations are amended as set out in these Regulations.

“14B. The salary rate that applies to a person appointed on probation:
to a position within the rank of constable, sergeant or superintendent; or
to a position of staff member at any level;
is the rate that the Commissioner considers appropriate having regard to the person’s experience, qualifications and training, and to any factors that are relevant to the duties of the position.”.

This regulation applies to appeals of the following kinds:
(a) an appeal by a staff member under regulation 18C (against a direction to act); and
(b) an appeal under Division 2A of Part 3 (against a promotion); and
(c) an appeal under section 38E of the Act (against retirement).
The Appeal Committee that is to hear an appeal must fix a date for the hearing of the appeal that is a date not earlier than:
(a) in the case of an appeal under section 38E of the Act—the day on which the Agency gives a statement and any requisite material to the appellant in accordance with subregulation 34C (4); or
(b) in that case or any other case—the latest day for lodging the notice of appeal.
“(3) The Appeal Committee must hear and decide an appeal:
(a) within 2 months of the earliest date that may be fixed under subregulation (2) for the hearing of an appeal; or
(b) if the Committee is unable, for good reason, to comply with paragraph (a)—by the earliest practicable date.”.
9.2 Subregulations 14N (6) and (7):

“25CA. (1) A member may appeal against the appointment of a staff member to a position of member within the rank of sergeant if:
(a) the appointment was made after publication of a joint advertisement for that position and a position of staff member at level 3; and
(b) the position of staff member at level 3 is not filled; and
(c) the member was an applicant for at least 1 of the advertised positions.
A member may appeal against the promotion of a staff member to a position of staff member at level 3, if:
(a) the promotion was made after publication of a joint advertisement for that position and a position of member within the rank of sergeant; and
(b) the position of member within the rank of sergeant is not filled; and
(c) the member was an applicant for at least 1 of the advertised positions.
This regulation applies subject to regulation 25CC.
“25CB. (1) A staff member may appeal against the appointment of a member to a position of staff member at level 3, if:
(a) the appointment was made after publication of a joint advertisement for that position and a position of member within the rank of sergeant; and
(b) the position of member within the rank of sergeant is not filled; and
(c) the staff member was an applicant for at least 1 of the advertised positions.
A staff member may appeal against the promotion of a member to a position of member within the rank of sergeant if:
(a) the promotion was made after publication of a joint advertisement for that position and a position of staff member at level 3; and
(b) the position of staff member at level 3 is not filled; and
(c) the staff member was an applicant for at least 1 of the advertised positions.
This regulation applies subject to regulation 25CC.
“25CC. (1) A member or staff member who appeals under regulation 25CA or 25CB against a promotion or appointment must give a notice of appeal to the Agency against the decision of the Commissioner to make the promotion or appointment.
Subregulations 26 (2), (3) and (4) apply to a notice of appeal given under subregulation (1), and for the purposes of subregulation 26 (4) a notice of that kind is taken to be given in accordance with regulation 26 if it complies with subregulations 26 (2) and (3).”.

Subject to these Regulations, a person who applied under subregulation 15 (2) for promotion to a position within a prescribed rank or level may appeal against the promotion of another person to the position.
“(1A) A person who appeals under subregulation (1) against a promotion must give a notice of appeal to the Agency against the decision of the Commissioner to make the promotion.”.
