Australian Federal Police (Police Liaison Advisory Committee for the Australian Capital Territory) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Australian Federal Police Act 1979.

Membership of Committee

1. Regulation 4 of the Australian Federal Police (Police Liaison Advisory Committee for the Australian Capital Territory) Regulations is amended—

(a) by omitting paragraph (1) (b) and substituting the following paragraph:

"(b) 5 members appointed by the Minister."; and

(b) by inserting after sub-regulation (1) the following sub-regulation:

"(1A) Where there are persons holding office as members of the House of Assembly, a person is not eligible to be appointed as a member referred to in paragraph (1) (b) unless the person is a member of the House of Assembly who has been nominated by that House.".

Termination of office

2. Regulation 5 of the Australian Federal Police (Police Liaison Advisory Committee for the Australian Capital Territory) Regulations is amended—

(a) by omitting from paragraph (1) (b) he ceases" and substituting "being a member of the House of Assembly, the member ceases"; and

(b) by omitting sub-regulation (2) and substituting the following sub-regulations:

"(2) A person who, immediately before the commencement date, held office as a member of the Committee referred to in paragraph 4(1) (b) ceases, by force of this sub-regulation, to hold that office.

"(3) A member of the Committee referred to in paragraph 4 (1) (b) who is appointed on or after the commencement date holds office, unless the member has previously ceased to hold office—

(a) where the member was, at the time of his or her appointment, a member of the House of Assembly—until the first meeting of the House of Assembly held after the election of members of that House next following the member's appointment; or

(b) where the member was not, at the time of his or her appointment, a member of the House of Assembly—

(i) until the first meeting of the House of Assembly held after the election of members of that House next following the member's appointment; or

(ii) until the expiration of the period of 3 years that commenced on the date of the member's appointment,

whichever first occurs.

"(4) In this regulation, 'commencement date' means the date of commencement of the sub-regulation in which the expression occurs.".
