Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Australian Federal Police Act 1979.

Commencement

1. These Regulations commence on 1 January 1989.

2. Before regulation 47 of the Australian Federal Police (Discipline) Regulations the following regulation is inserted in Part V:

Seniority

“46. (1) Subject to this regulation, a member who holds a rank is senior to the members:

(a) whose appointments or promotions to that rank were made after his or her appointment or promotion to that rank was made; or

(b) who hold a lower rank.

“(2) The Commissioner may determine the relative seniority of members appointed or promoted to the same rank on the same day.

“(3) In determining seniority under subregulation (2), the Commissioner may take into account:

(a) the ranks from which the members were promoted; and

(b) the relative seniority of any of those members within any rank.

“(4) This regulation does not apply in relation to a member or the duties and powers of a member except in respect of functions of command and control.”.
