Alteration of other rules of organisation.

[1]        On 12 August 2016, the Victorian Branch of the Australian Education Union lodged

with the Fair Work Commission a notice and declaration setting out particulars of alterations

to the rules. Following consultation with the branch, a further declaration was received on 22

September 2016.

[2]        The particulars set out alterations to rules 4, 17 and 57 of the rules. The alterations

make changes to the election provisions including the delivery of nominations to the returning

officer.

[3]        The existing nomination provisions within the Victorian Branch rules were the

subject of an adverse report from the AEC in E2016/61. The alterations address the matters

subject of the adverse report. Parts of the particulars were provided to the AEC by the

branch in its reply.

[4]        On the information contained in the notice and the further declaration, I am satisfied

the alterations have been made under the rules of the organisation.

[5]        In my opinion, the alterations comply with and are not contrary to the Fair Work

(Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise

agreements, and are not otherwise contrary to law. I certify accordingly under subsection

159(1) of the Fair Work (Registered Organisations) Act 2009.
