Alteration of other rules of organisation.

[1]        On 23 December 2014 the Australian Education Union lodged with the Fair Work

Commission a notice and declaration setting out particulars of alterations to the Federal

Branch Rules of the Australian Education Union’s Tasmania Branch.

[2]        The particulars set out alterations to Tasmanian Federal Branch Rules 5, 12, 13, 32,

39, 43 and to Schedules B and C of those rules.

[3]        On 4 March 2014, the Tasmanian Branch provided further information about the

process used to transact the alterations.

[4]        On the information provided, I am satisfied the alterations have been made under the

rules of the organisation.

[5]        On 4 March 2015 the Branch President gave consent, under subsection 159(2) of the

Fair Work (Registered Organisations) Act 2009, for the Delegate to make various

amendments to the alterations for the purpose of correcting typographical, clerical or formal

errors. Accordingly the following corrections have been made:

 In proposed Federal Branch Rule 5(3)(a), the reference to Rule 12(5) has been

changed to Rule 5(2);

 In proposed rule Federal Branch Rule 5(3)(b), the reference to Rule 13(3) has been

changed to Rule 5(2); and

 In proposed rule Federal Branch Rule 32(2)(a), the reference to Sector Council

members has been changed to DoE Sector Council members and Support Staff Sector

members.

[6]        In my opinion, the alterations comply with and are not contrary to the Fair Work

(Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise

agreements, and are not otherwise contrary to law. I certify accordingly under subsection

159(1) of the Fair Work (Registered Organisations) Act 2009.
