HAYNE J:   The second respondent to this application has filed a submitting appearance.  Neither of the other parties seeks to supplement its summary of argument with oral submissions. 

The applicant, the Australian Crime Commission, accepts that if special leave to appeal is granted the Commission should pay the first respondent’s costs of the appeal in any event.  The Commission accepts that it should not seek to disturb the costs orders made, either by the Full Court of the Federal Court or at first instance.  On those conditions there will be a grant of special leave to appeal in this matter.
