HIS HONOUR:   The Australian Competition and Consumer Commission seeks orders granting it leave to amend its application for special leave to appeal and extending the time for filing its summary of argument and draft notice of appeal.  The respondent does not seek to be heard in opposition to those orders. 

Accordingly, there will be orders in the terms of paragraphs 1 and 2 of the Commission’s summons of 17 January 2013.  In addition, the parties have liberty to apply on not less than three days’ notice in writing to the opposite party.  Costs of the summons will be costs in the application for special leave.
