REGULATIONS UNDER THE AUSTRALIAN COMMISSION ON ADVANCED EDUCATION ACT 1971.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Australian Commission on Advanced Education Act 1971.

AUSTRALIAN COMMISSION ON ADVANCED EDUCATION REGULATIONS

Citation.

1. These Regulations may be cited as the Australian Commission on Advanced Education Regulations.

Definitions.

2.In these Regulations, unless the contrary intention appears—

“Committee” means a Committee appointed under section 17 of the Act;

“the Act” means the Australian Commission on Advanced Education Act 1971.

Travelling allowances.

3.—(1.) Subject to the next succeeding sub-regulation, where the Chairman of the Commission is necessarily absent from Canberra overnight in the course of the performance of his duties as Chairman of the Commission or as a member of a Committee, travelling allowance is payable to him in respect of the period of absence.

(2.) Where the Chairman remains overnight in Melbourne in the course of performing his duties as Chairman or as a member of a Committee, travelling allowance is not payable to him under the last preceding sub-regulation—

(a) in respect of the period during which he is in Melbourne; or

(b) it he travels directly from Canberra to Melbourne for the purpose of performing those duties or travels directly from Melbourne to Canberra after having performed those, duties—in respect of the period which he is travelling.

(3.) For the purposes of the last preceding sub-regulation, where the Chairman is not absent from Canberra or Melbourne overnight in the course of travelling from Canberra to Melbourne or from Melbourne to Canberra, he shall be deemed to travel directly from Canberra to Melbourne or from Melbourne to Canberra, as the case may be, notwithstanding that he does not so travel by the most direct route or that he performs duty in a place other than Canberra or Melbourne in the course of so travelling.

(4.) Where—

(a) a member of the Commission other than the Chairman; or

(b)a person, not being a member of the Commission, who is a member of a Committee,

is necessarily absent overnight from the city or town in which he ordinarily resides in the course of the performance of his duties, travelling allowance is payable to him in respect of the period of absence.

(5.) Travelling allowance is payable under sub-regulation (1.) or (4.) of this regulation at the rate of Twenty-one dollars per day.

(6.) Travelling allowance payable under this regulation is in addition to, and does not include, the cost of conveyance.

(7.) In this regulation, a reference to the Chairman of the Commission shall be read as not including a reference to an acting Chairman of the Commission.

(8.) Travelling allowance is payable in accordance with this regulation—

(a) to a member of the Commission in respect of any period of office after the eighteenth day of January, 1972; and

(b) to a person, not being a member of the Commission, who is a member of a Committee in respect of any period of office after the ninth day of February, 1972.

Sitting fees.

4.—(1.) A member of a Committee shall be paid for each day on which he attended a meeting of the Committee after the ninth day of February, 1972, and before the commencement of these Regulations or on which he attends such a meeting—

(a) in the case of a member, being the Chairman—

(i) if the duration of the meeting is not less than three hours— Forty dollars; or

(ii) if the duration of the meeting is less than three hours— Twenty-five dollars; or

(b) in the case of a member, not being the Chairman—

(i) if the duration of the meeting is not less than three hours— Thirty-five dollars; or

(ii) if the duration of the meeting is less than three hours— Twenty dollars.

(2.) The last preceding sub-section does not apply to a member of a Committee who—

(a) is an officer of, or is temporarily employed in, the Public Service of the Commonwealth; or

(b) is an officer of, or is employed by, an authority of the Commonwealth and is required by the terms of his employment to give the whole of his time to the duties of his employment.
