Australian College of Ministries Ltd and Staff Employee Collective Agreement 2009.
[1] An application has been made for approval of an enterprise agreement known as the Australian College of Ministries Ltd and Staff Employee Collective Agreement 2010 (“the Agreement”). The application was made pursuant to s.185 of the Fair Work Act 2009 (“the Act”). The application has been made by the Australian College of Ministries T/A ACOM (“the applicant”). The Agreement is a single-enterprise agreement.
[2] In proceedings on 10 June 2010, I raised a number of queries about the pre-approval steps in circumstances where the employer’s declaration suggested they had not been met, although, the submissions indicated, due to a genuine misunderstanding. The proceedings were adjourned to allow the applicant to seek advice in relation to the matters I raised.
[3] On 17 June 2010, a notice of discontinuance was subsequently filed. In the circumstances, the hearing that had been listed for 21 June 2010 has been vacated and the proceedings are now concluded.
