1Name

This instrument is the Australian Citizenship Amendment (Translation Requirements for Applications) Regulations 2022.

2Commencement

1. (1)

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

At the end of Part 4

Add:

32Application of amendment made by Part 1 of Schedule 1 to the Australian Citizenship Amendment (Translation Requirements for Applications) Regulations 2022

1. (1)

   The repeal of section 14 by Part 1 of Schedule 1 to the Australian Citizenship Amendment (Translation Requirements for Applications) Regulations 2022 applies in relation to an application made before the commencement of that Part if:

   1. (a)

      a decision on the application had not been made before that commencement; or

   2. (b)

      a decision on the application had been made before that commencement and one of the following applies:

      1. (i)

         as at that commencement, the time for making an application for review of the decision under section 52 of the Act has not ended;

      2. (ii)

         as at that commencement, the decision is subject to a review under section 52 of the Act that has not been completed;

      3. (iii)

         before that commencement, the decision was remitted to the Minister following a review under section 52 of the Act, and the Minister has not, as at that commencement, reconsidered the decision.

2. (2)

   The repeal of section 14 by Part 1 of Schedule 1 to the Australian Citizenship Amendment (Translation Requirements for Applications) Regulations 2022 also applies in relation to an application made on or after the commencement of that Part.
