Australian Capital Territory Representation Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Australian Capital Territory Representation (House of Representatives) Act 1973.

Commencement

1. These Regulations shall come into operation on 26 January 1984.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Australian Capital Territory Representation Regulations.

Persons entitled to enrolment

3. Regulation 11 of the Principal Regulations is amended by omitting paragraph (a) and substituting the following paragraph:

“(a) who is—

(i) an Australian citizen; or

(ii) a British subject (other than an Australian citizen) whose name, on 25 January 1984, appeared on an electoral roll kept for the purpose of electing, in a State or Territory, a Member of the House of Representatives;”.

Certain members of the Defence Force entitled to vote

4. Regulation 14 of the Principal Regulations is amended by omitting paragraph (1) (c) and substituting the following paragraph:

“(c) is an Australian citizen,”.

Questions to be put to voter

5. Regulation 47 of the Principal Regulations is amended—

(a) by omitting from sub-paragraph (1) (a) (iii) “and”;

(b) by omitting sub-paragraph (1) (b) (v) and substituting the following sub-paragraph:

“(v) Are you an Australian citizen?”;

(c) by omitting from sub-paragraph (1) (b) (vi) “and”;

(d) by inserting after paragraph (1) (b) the following paragraphs:

“(ba) shall also put to any person who answered the question numbered (v) in the negative the following question:

(via) Are you a British subject?

(bb) shall also put to any person who answered the question numbered (via) in the affirmative the following question:

(vib) On 25 January 1984, was your name on an electoral roll kept for the purpose of electing, in a State or Territory, a Member of the House of Representatives? and”;

(e) by omitting from paragraph (2) (d) “(v),”; and

(f) by inserting after paragraph (2) (d) the following word and paragraph:

“; or (e) does not answer the question numbered (v) absolutely in the affirmative when put to him, or, if he answers that question in the negative, does not answer both the question numbered (via) and the question numbered (vib) absolutely in the affirmative when put to him,”.

Schedule 1

6. (1) Schedule 1 to the Principal Regulations is amended by omitting paragraph (c) of the declaration in Form 2 and substituting the following paragraph:

“(c) I am an Australian citizen (or a British subject who on 25 January 1984 was on an electoral roll kept for the purposes of a House of Representatives election);”.

(2) Schedule 1 to the Principal Regulations is amended by omitting paragraph (1) (d) in Part B of Form 15 and substituting the following paragraph:

“(d) that I am an Australian citizen; and”.
