1  Name

This instrument is the Australian Capital Territory National Land (Road Transport) (Parking Fees) Determination 2021.

3  Authority

This instrument is made under section 96 of the Road Transport (General) Act 1999 (ACT), as applied by the National Land (Road Transport) Ordinance 2014 and as modified by that Ordinance and the Australian Capital Territory National Land (Road Transport) (Parking Legislation, Fees and Permits) Rules 2021.

4  Definitions

In this instrument:

fee means a fee, charge or other amount within the meaning of section 96 of the Road Transport (Safety and Traffic Management) Regulation 2017 (ACT) (as in force at the commencement of this instrument and as modified by or under the National Land (Road Transport) Ordinance 2014).

multi‑stay parking space means a ticket parking space where all‑day parking is permitted by the signs applying to the space.

NCA chief executive has the same meaning as in the National Land (Road Transport) Ordinance 2014.

short‑stay parking space means any ticket parking space other than a multi‑stay parking space.

ticket parking area has the same meaning as in the Road Transport (Safety and Traffic Management) Regulation 2017 (ACT) (as in force at the commencement of this instrument and as modified by or under the National Land (Road Transport) Ordinance 2014).

ticket parking space has the same meaning as in section 39 of the Road Transport (Safety and Traffic Management) Regulation 2017 (ACT) (as in force at the commencement of this instrument and as modified by or under the National Land (Road Transport) Ordinance 2014).

5  Fees

(1) The fee payable for use of a ticket parking space in a ticket parking area set aside by the NCA chief executive under paragraph 35(2)(a) of the Road Transport (Safety and Traffic Management) Regulation 2017 (ACT) is the amount set out in the following table:

1 Short‑stay parking space for up to and including 4 hours—$3.60 per hour (pro‑rated for part of an hour).
2 Multi‑stay parking space

(a) $3.60 per hour (pro‑rated for part of an hour) up to the amount mentioned in paragraph (b); or

(b) for 1 day—$16.00; or

(c) for 5 days—$77.50.

(2)  The fee is payable to the Commonwealth by the person using the space.
