    An Act to make temporary provision for the Law of Evidence in the Australian Capital Territory

    Short title

    1.  This Act may be cited as the Australian Capital Territory Evidence (Temporary Provisions) Act 1971.1

    Commencement

    2.  This Act shall be deemed to have come into operation on the nineteenth day of August, One thousand nine hundred and seventy-one.

    Validation of provisions of Australian Capital Territory Evidence Act

    3.  (1) The provisions of the Australian Capital Territory Evidence Act 1971 contained in Australian Capital Territory Act No. 4 of 19712 shall, notwithstanding its disallowance by the Senate, continue in force.

    (2)  Nothing in subsection (1) prevents the amendment or repeal by an Act under the Seat of Government (Administration) Act 1910 of the Commonwealth of the provisions continued in force by that subsection.

    (3)  The Interpretation Act 1967 of the Australian Capital Territory, as amended and in force from time to time, applies, and shall be deemed to have always applied, to the provisions continued in force by subsection (1).

    NOTES

    1.  The Australian Capital Territory Evidence (Temporary Provisions) Act 1971 as shown in this reprint comprises Act No. 66, 1971 of the Commonwealth (as amended).

    The Australian Capital Territory (Self-Government) Act 1988 (No. 106, 1988) of the Commonwealth subsection 34 (2) and Schedule 2 allowed for the conversion of certain Commonwealth laws (including that first mentioned Act) to Territory enactments.

    Citation of Laws—The Self-Government (Citation of Laws) Act 1989 (No. 21, 1989) altered the citation of most ACT laws so that after Self-Government day, or when they become Territory enactments they are to be cited as Acts.  That Act also affects references in ACT laws to Commonwealth Acts.

    (a)    The Australian Capital Territory Evidence (Temporary Provisions) Act 1971 was amended by section 3 only of the Statute Law (Miscellaneous Amendments) Act 1981, subsection 2 (12) of which provides as follows:

    “(12)  The remaining provisions of this Act shall come into operation on the twenty-eighth day after the day on which this Act receives the Royal Assent.”
