REGULATIONS UNDER THE BROADCASTING ACT 1942-1950.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Broadcasting Act 1942-1950.

Amendments of the Australian Broadcasting Commission (Staff) Regulations. 

1.— (1.) Regulation 43 of the Australian Broadcasting Commission (Staff) Regulations is repealed and the following regulation inserted in its stead :—

Allowances where officers unable to obtain private residence.

“ 43.— (1.) Where a married officer is required, by reason of appointment, promotion, transfer or change of station, to perform his duties in a locality other than that in which he maintains his private residence and the officer cannot enter into occupation of a private residence in that locality by reason of unavoidable delay in the removal of his furniture and household effects or of the fact that a suitable private residence is not available for him in that locality, the General Manager may grant to the officer an allowance in accordance with this regulation.

“ (2.) If the officer is obliged to reside for the time being with his family (if any) at an, hotel or other house of accommodation, the General Manager may grant the officer an allowance equal to the difference between the officer’s ordinary household expenditure and the cost of board and lodging of himself and family (if any), but not exceeding one-half of the cost of that board and lodging.

“ (3.) If the officer’s family has not removed with him to the locality, the General Manager may grant the officer an allowance at such rate (if any) as the General Manager determines upon the officer furnishing, as and when required by the General Manager, satisfactory evidence of increased expenditure incurred by him.

“ (4.) An allowance granted under this regulation shall be payable during such period as the General Manager determines.

“ (5.) For the purposes of this regulation, an unmarried officer or a widower who is maintaining a home or supporting dependent relatives in circumstances which, in the opinion of the General Manager, justify his being deemed to be a married officer, shall be deemed to be a married officer.”.

(2.) This regulation shall be deemed to have come into operation on the first day of December, 1948.

Travelling allowances.

2.—(1.) Regulation 76 of the Australian Broadcasting Commission (Staff) Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulations :—

“ (1.) An officer who, in accordance with his duty, is required to be absent overnight from his head-quarters shall, subject to this regulation, be paid travelling allowance in accordance with the following table :—

“ (1a.) Travelling allowance shall be paid—

(a) at the capital city rate specified in the last preceding sub-regulation while the officer is in a capital city or travelling—

(i) on an unbroken journey from one capital city to another capital city; or

(ii) on an unbroken journey from a place other than a capital city to a capital city and on an unbroken return journey from that capital city to that other place if, at the commencement of the first-mentioned journey, the return journey is contemplated ; or

(b) at the other than capital city rate specified in the last preceding sub-regulation while the officer is in a place other than a capital city or travelling in circumstances other than those specified in the last preceding paragraph.”.

(2.) This regulation shall be deemed to have come into operation on the first day of April, 1950.

3. Regulation 77 of the Australian Broadcasting Commission (Staff) Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table :—

4. Regulation 78 of the Australian Broadcasting Commission (Staff) Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table :—

Leave on resignation or retirement.

5.—(1.) Regulation 91 of the Australian Broadcasting Commission (Staff) Regulations is amended—

(a) by omitting sub-regulation (1.) and inserting in its stead the following sub-regulations:—

“ (1.) Where an officer who has not attained the age of sixty years—

(a) submits his resignation or is about to be retired from the service of the Commission ; and

(b) has reached the anniversary in that year of his appointment to the service of the Commission or the anniversary of the date of commencement of his employment where the officer was, prior to his appointment to the service of the Commission, a temporary employee or a member of the auxiliary programme staff and his service as such an employee or member was continuous with his service after appointment to the service of the Commission,

he may be granted recreation leave due to him in respect of the calendar year in which his services terminate.

“ (1a.) Where an officer who has attained the age of sixty years submits his resignation or is about to be retired from the service of the Commission, he may be granted recreation leave in respect of the year in which he retires although he has not reached the anniversary in that year of his date of appointment to the service of the Commission.” ; and

(b) by adding at the end thereof the following sub-regulation :—

“ (4.) This regulation shall not operate so as to entitle an officer to recreation leave after he has attained the age of sixty-five years.”.

(2.) This regulation shall be deemed to have come into operation on the first day of June, 1950.

Recreation leave for temporary employees.

6. Regulation 138 of the Australian Broadcasting Commission (Staff) Regulations is amended by omitting sub-regulation (4.) and inserting in its stead the following sub-regulation :—

“ (4.) Where—

(a) a temporary employee resigns or the services of a temporary employee are terminated otherwise than on the ground of misconduct ; and

(b) at the time of resignation or termination, the employee has completed less than twelve months’ continuous service since the date of his appointment or the date on which he last completed a period of twelve months’ continuous service,

the employee shall be eligible for payment of an amount calculated at the rate of one and one-quarter days’ salary for each completed month of continuous service less than twelve months’ continuous service.”.

Special sick leave.

7. Regulation 149 of the Australian Broadcasting Commission (Staff) Regulations is amended by omitting from sub-regulation (1.) the word “ five ” and inserting in its stead the word “ ten ”.
