DECISION

Fair Work (Registered Organisations) Act 2009
s.159—Alteration of other rules of organisation
Australian and International Pilots Association
(R2013/144)
MR ENRIGHT MELBOURNE, 28 AUGUST 2013
Alteration of other rules of organisation.

[1]        On 21 February 2013, the Australian and International Pilots Association lodged with

the Fair Work Commission a notice and declaration setting out particulars of alterations to the
rules of the Australian and International Pilots Association.

[2] The particulars set out alterations to Rules 5, 15, 21, 32, 34, 37, 38, 39, 40 and 56A of the rules of the Australian and International Pilots Association. The alterations operate to introduce email as a means of communication, electronic transfers as a method of payment, reduce the quorum at general meetings and incorporate, where possible, the existing alterations to elections which are currently contained in transitional rule 56A.

[3]        Further correspondence was received by the Commission on 7 June 2013, 23 August

2013 and 27 August 2013.

[4]        On the information contained in the notice and additional material, I am satisfied the

alterations have been made under the rules of the organisation.

[5]        On 27 August 2013, James Wirth, Secretary, gave consent under 159(2) of the Fair

Work (Registered Organisations) Act 2009, for the Delegate to make various alterations for

the purpose of correcting typographical, clerical or formal errors. Accordingly in proposed
rules 15(g)(i) and 15(g)(ii) I have corrected the spelling of ‘authorised’.

[6]        In my opinion, the alterations comply with and are not contrary to the Fair Work

(Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise

agreements, and are not otherwise contrary to law. I certify accordingly under subsection

159(1) of the Fair Work (Registered Organisations) Act 2009.
