1  Name

This is the Australian Aged Care Quality Agency (Other Functions) Amendment (Short-term Restorative Care) Instrument 2016.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under the Australian Aged Care Quality Agency Act 2013.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Australian Aged Care Quality Agency (Other Functions) Specification 2015

1  Section 1

Repeal the section, substitute:

1  Name

This is the Australian Aged Care Quality Agency (Other Functions) Instrument 2015.

2  Sections 4 and 5

Omit “Specification”, substitute “instrument”.

3  Section 5

Insert:

Act means the Australian Aged Care Quality Agency Act 2013.

4  Section 5 (definition of CEO)

Repeal the definition.

5  Section 5

Insert:

Flexible Care Standards means the Flexible Care Standards set out in the Quality of Care Principles made under section 96‑1 of the Aged Care Act 1997.

6  Section 5

Repeal the following definitions:

(a)  definition of Quality Agency;

(b)  definition of Secretary.

7  After section 5

Insert:

5A  Other functions of the CEO

For paragraph 12(h) of the Act, Schedule 1 sets out other functions of the CEO.

8  Schedule 1 (heading)

Repeal the heading, substitute:

Schedule 1—Other functions of the CEO

Note:       See section 5A.

9  Clause 1 of Schedule 1

Omit “For paragraph 12(h) of the Act, the”, substitute “The”.

10  Clause 2 of Schedule 1

Omit “For paragraph 12(h) of the Act, the”, substitute “The”.

11  At the end of Schedule 1

Add:

Part 2—Other additional functions

3  Functions relating to flexible care provided as short‑term restorative care

The CEO has the following functions:

(a)  in relation to flexible care services through which short‑term restorative care is provided in a residential care setting—to accredit the flexible care services in accordance with the Quality Agency Principles, and the Flexible Care Standards that apply to the services;

(b)  in relation to flexible care services through which short‑term restorative care is provided in a home care setting—to conduct the quality review of the flexible care services in accordance with the Quality Agency Principles, and the Flexible Care Standards that apply to the services.
