1Name of Regulations

 These Regulations are the Australia New Zealand Food Authority Amendment Regulations 2001 (No. 1).

2Commencement

 These Regulations commence on gazettal.

3Amendment of Australia New Zealand Food Authority Regulations 1994

 Schedule 1 amends the Australia New Zealand Food Authority Regulations 1994.

6ABoard of Food Standards Australia New Zealand — prescribed organisations and public bodies from which nominations may be sought (Act s 40)

• (1)

  For paragraph 40 (3) (b) of the Act, each organisation and public body mentioned in column 2 of an item in Part 1 of Schedule 2A is prescribed for the purposes of each subparagraph of paragraph 40 (3) (a) of the Act mentioned in column 3 of that item.

• (2)

  For paragraph 40 (4) (b) of the Act, each organisation and public body mentioned in column 2 of an item in Part 2 of Schedule 2A is prescribed for the purposes of each subparagraph of paragraph 40 (4) (a) of the Act mentioned in column 3 of that item.

• (3)

  In this regulation, a reference to paragraph 40 (3) (a) or (b) of the Act, or 40 (4) (a) or (b) of the Act, is a reference to that paragraph of the Act, as amended by Schedule 1 to the Australia New Zealand Food Authority Amendment Act 2001.

Note Section 40 of the Act is to be amended by Schedule 1 to the Australia New Zealand Food Authority Amendment Act 2001 (the ANZFA Amendment Act). At the date of commencement of this regulation, the amendments had not come into operation. However, item 120A of Schedule 1 to the ANZFA Amendment Act provides that the power to make regulations for paragraphs 40 (3) (b) and 40 (4) (b) of the Act, as amended by Schedule 1 to the ANZFA Amendment Act, may be exercised before the commencement of those provisions as if those provisions had come into operation.
