Proposed protected action ballot by employees of JBS Australia Pty Ltd - Rockhampton plant.

[1] This is an application pursuant to s.437 of the Fair Work Act 2009 (the Act) by The Australasian Meat Industry Employees Union for a protected action ballot order in relation to employees who are employed at the JBS Australia Pty Ltd Meat processing plant at Rockhampton.

[2] The Company, JBS Australia Pty Ltd has advised by email on 17 May 2012 that it is not contesting the application.

[3] In the circumstances I have decided to determine the matter on the papers as I am satisfied it is not necessary to hold a hearing.

[4] I am satisfied that the requirements in s.443(1) of the Act have been met and that, accordingly, an order must be made. An order [PR523975] based on the draft order provided by The Australasian Meat Industry Employees Union has been issued in conjunction with this decision.
