Alteration of other rules of organisation.

[1]        On 12 May 2015 The Australasian Meat Industry Employees Union (the organisation)

lodged with the Fair Work Commission (the Commission) a notice and declaration setting out

particulars of alterations to the rules of the organisation.

[2]        The particulars set out alterations to rules 6 and 46 of the rules of the organisation.

[3]        On 9 July 2015 the Commission wrote to the organisation to seek confirmation that the

quorum requirement for the Federal Executive meeting held on 22 April 2015, wherein the

rule-altering resolution was passed, was met in accordance with the organisation’s rules. The

correspondence also sought consent from the organisation to correct what appeared be a

typographical, clerical or formal error in sub-rule 46.5 of the rules of the organisation.

[4]        On 17 July 2015 the organisation lodged a further declaration which stated that the

quorum requirement for the Federal Executive meeting of 22 April 2015 had been met in

accordance with the organisation’s rules. The organisation also consented to correct a

typographical, clerical or formal error in sub-rule 46.5 of the rules of the organisation.

Accordingly, the following correction has been made pursuant to section 159(2) of the Fair

Work (Registered Organisations) Act 2009:

 In sub-rule 46.5 the word “application” has been replaced with the word

“notification”.

[5]        On the information contained in the notice and the further declaration, I am satisfied

the alterations have been made under the rules of the organisation.

[6]        In my opinion, the alterations comply with and are not contrary to the Fair Work

(Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise

agreements, and are not otherwise contrary to law. I certify accordingly under subsection

159(1) of the Fair Work (Registered Organisations) Act 2009.
