Minor change where small caravan park associated with proposed miners'accommodation is replaced by a smaller number of holiday units and the accommodation is relocated away from sewerage works adjoining the site
HIS HONOUR: The Court makes an order in terms of the initialled draft which allows this conditions appeal.
The Court has to be satisfied that the changes made to the development application represent minor changes within section 350 of the Sustainable Planning Act 2009. It's comfortably so satisfied. The proposal is one essentially for 400 accommodation units for workers in the coalfields. There had been proposed in addition a caravan park with about 20 places. That's been dispensed with and instead five units offering some kind of “eco-holiday” experiences for customers are to be provided.
More significantly, the layout of the proposal changes. The sensitive receptors, as they might be called, where people will be accommodated are to be located much further away on the large site than originally proposed from the council's sewerage works. The council is pleased about the changes. They are well within section 350.
