THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting

with the advice of the Federal Executive Council, hereby make the following

Regulations under th& Audit Act 1901.

Commencement

1. Regulations 2, 3 and 4 of these Regulations shall come into operation on

1 July 1984.

2. Regulation 2 of the Audit Regulations is repealed and the following

regulation substituted:

Interpretation

“2.

In these Regulations, unless the contrary intention appears-

‘Division’ means a Division of Part XI of the Act;

‘the Act’ means the Audit Act 1901.".

Application of Di visions 2 and 3 to A.C.T. public authorities

3. Regulation 2A of the Audit Regulations is amended by omitting

sub-regulation (1) and substituting the following sub-regulations:

“ (1)

In this regulation, unless the contrary intention appears

‘authority’ means a body corporate incorporated for a public purpose by an Ordinance of the Territory or by regulations made under such an Ordinance;

‘Territory’ means the Australian Capital Territory.

“ (lA)

In this regulation, a reference to a column by number is a reference

to the column so numbered in Part I of Schedule 1

Schedule 1

4. Schedule 1 to the Audit Regulations is repealed and the Schedule set out

in the Schedule to these Regulations is substituted.

Schedule 2

5. Schedule 2 to the Audit Regulations is amended—

(a)

by omitting from the heading “AUDIT”;

(b)

by inserting—

“Army and Air Force Canteen Service Board of Management”

after—

“Albury-Wodonga Development Corporation”;

and

(c)

by inserting—

“Australian Centre for International Agricultural Research”

after—

“Australian Capital Territory Schools Authority”.

PART II

MODIFICATIONS OF DIVISION 3 AUSTRALIAN CAPITAL TERRITORY SCHOOLS

AUTHORITY

1. Insert after sub-section 63m (I):

“ (1Λ)

The report shall set out all approvals and directions given by the appropriate Minister under

section 6 of the Schools Authority Ordinance 1976 of the Australian Capital Territory during that

year.”.

2. Insert ”, and the Australian Capital Territory House of Assembly,” after “Parliament” in sub-section 63m (3).

3. Add at the end of section 63M the following sub-section:

“ (4)

The first report and financial statements of the authority under this section shall relate to the

operations of the authority during the year that ended on 30 June 1980.".

4. After section 63m add the following section:

"63ma. Nothing in this Division shall be taken to be in derogation of sections 29, 31 and 35 of the

Schools Authority Ordinance 1976 of the Australian Capital Territory.”.

PART III

MODIFICATIONS OF DIVISION 2 -BUILDING AND CONSTRUCTION INDUSTRY

LONG SERVICE LEAVE BOARD

1. Insert

and the Australian Capital Territory House of Assembly,” after “Parliament” in

sub-section 63i! (3).

2. Add at the end of section 63ll the following sub-section:

“ (4) The first report and financial statements of the authority under this section shall relate to the operations of the authority during the period commencing on the dale of commencement of Part II of the Long Service Leave (Building and Construction Industry) Ordinance 1981 of the Australian Capital Territory and ending on 30 June 1982.".

3. After section 63U add the following section:

“63ΙΙΛ. Nothing in this Division shall be taken to be in derogation of Division 3 of Part II of the Long Service Leave (Building and Construction Industry) Ordinance 1981 of the Australian Capital Territory.”.

PART IV

MODIFICATIONS OF DIVISION 3 BUSH FIRE COUNCIL

1. Omit section 63j.

2. Insert in sub-section 63M (3) ", and the Australian Capital Territory House of Assembly,” after “ Parliament”.

The report shall set out any direction given, under section 20 of the Canberra Theatre Trust

Ordinance 1965 of the Australian Capital Territory, by the appropriate Minister to the authority during the year to which the report relates.".

2. Insert in sub-section 63ll (3)

and the Australian Capital Territory House of Assembly,” after

“Parliament".

MODIFICATIONS OF DIVISION 3 -CAPITAL TERRITORY HEALTH COMMISSION

1. Insert after sub-section 63m (1) the following sub-section:

“ (1Λ) The report shall set out any direction given, under sub-section 7 (4) of the Health Commission Ordinance 1975 of the Australian Capital Territory, by the appropriate Minister to the authority during the year to which the report relates.”.

2. Insert in sub-section 63m (3) “, and the Australian Capital Territory I louse of Assembly," after

“Parliament”.

PART VIII

MODIFICATIONS OF DIVISION 3—LEGAL AID COMMISSION (A.C.T.)

1. Omit section 63J.

2. Insert in sub-section 63m ( I ) “and the Australian Capital Territory House of Assembly" alter

“Minister” (first occurring).

PART IX

MODIFICATIONS OF DIVISION 2-M IL K AUTHORITY OF THE AUSTRALIAN

CAPITAL TERRITORY 1. Insert after sub-section 6311 (1) the following sub-section: “ (1λ ) The report shall set out any direction given, under section 18λ of the Milk Authority

Ordinance 1971 of the Australian Capital Territory, by the appropriate Minister to the authority

during the year to which the report relates.".

2. Insert in sub-section 6311 (3)

and the Australian Capital Territory House of Assembly," after

“Parliament".

PART X

MODIFICATIONS OF DIVISION 2 -NATIONAL EXHIBITION CENTRE TRUST

1. Insert after sub-section 63ll (1) the following sub-section:

“(1Λ) The report referred to in sub-section (1) shall include details of any approval or direction

given, under the National Exhibition Centre Trust Ordinance 1976 of the Australian Capital

Territory, by the appropriate Minister to the authority during the year to which the report relates.”.

2. Insert in sub-section 6311 (3) “, and the Australian Capital Territory House of Assembly,” after

"Parliament".
