4 Audit and Parliamentary Committees (Miscellaneous Amendments) No. 45, 1992 BE IT ENACTED by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows. PART 1—PRELIMINARY ˙ Short title 1. This Act may be cited as the Audit and Parliamentary Committees (Miscellaneous Amendments) Act 1992 . PART 2—AMENDMENT OF THE FINANCIAL ADMINISTRATION AND AUDIT ACT 1977 ˙ Amended Act 2. The Financial Administration and Audit Act 1977 is amended as set out in this Part and Schedule 1. ˙ Replacement of s.51 (Tenure of office) 3. Section 51— omit, insert— ˙ ‘Term of appointment ‘51.(1) Subject to this Act, the Auditor-General holds office for such term (not longer than 7 years) as is specified in the instrument of appointment. ‘(2) A person appointed as Auditor-General is not eligible for reappointment. ’.
5 Audit and Parliamentary Committees (Miscellaneous Amendments) No. 45, 1992 ˙ Amendment of s.69 (Secrecy) 4. After subsection 69(2)— insert— ‘(3) Subsections (1) and (2) do not prevent the disclosure of information to, or the giving of a document to— (a) the Parliamentary Committee of Public Accounts; or (b) the Parliamentary Committee of Public Works; or (c) the Criminal Justice Commission; or (d) a police officer, or a person or body responsible for the investigation or prosecution of offences, if the information or document relates to the investigation or prosecution of an offence; or (e) a court for the purposes of the prosecution of a person for an offence. PART 3—AMENDMENT OF THE PUBLIC ACCOUNTS COMMITTEE ACT 1988 ˙ Amended Act 5. The Public Accounts Committee Act 1988 is amended as set out in this Part and Schedule 2. ˙ Omission of s.22 (Certain evidence not admissible if against public interest) 6. Section 22— omit.

Section 3(1) (definitions “Crown Law Officer” and “Minister”)— omit. 2. Section 3(2)— omit. 3. Section 4— omit, insert— ‘Act not to apply to prescribed constructing authorities ‘4. If the Governor in Council is satisfied that— (a) a constructing authority operates in a competitive commercial environment in carrying out its functions; and (b) it is in the public interest that this Act not apply to the constructing authority. the Governor in Council may, by regulation, declare that this Act does not apply to the constructing authority. ’. 4. Section 22(4)— omit ‘ 29, 30 ’.
