AUCTIONEERS, STOCK AND STATION, REAL ESTATE AND BUSINESS AGENTS (AMEND- MENT) ACT.

Act No. 10 ,1965.

An Act to increase the remuneration and fees payable to members of the Council of the Auctioneers, Stock and Station Agents, Real Estate Agents and Business Agents and the fees payable for licenses and certificates of registration issued under the Auctioneers, Stock and Station, Real Estate and Business Agents Act, 1941-1957; for these purposes to amend the said Act; to validate certain matters: and for purposes connected therewith. [Assented to, 11th October, 1965.]

BE

"DE it enacted by the Queen's Most Excellent Majesty, by ** and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows: —

(1) This Act may be cited as the "Auctioneers, Stock

and Station, Real Estate and Business Agents (Amendment)
Act, 1965".

(2) The Auctioneers, Stock and Station and Real Estate Agents Act, 1941, as amended by subsequent Acts and by this Act, may be cited as the Auctioneers, Stock and Station, Real Estate and Business Agents Act, 1941-1965.

2. The Auctioneers, Stock and Station, Real Estate and Business Agents Act, 1941-1957, is amended—

(a) by omitting subsection one of section fourteen and by inserting in lieu thereof the following subsec- tions : —

(1) The chairman and members of the council shall be entitled to be paid remuneration and fees at the prescribed rates and such travelling and sus- tenance expenses as may from time to time be determined by the Governor.

The prescribed rate of remuneration is—

(a) in the case of the chairman, two hundred

(b) in the case of a member other than the pounds per annum; and
chairman, one hundred pounds per annum.

The prescribed rate of fees is—

(a)

in the case of the chairman, five guineas; and

(b)

in the case of a member other than the chairman, four guineas,

for each meeting of the council attended by the

chairman or member, as the case may be.

This subsection shall be deemed to have commenced upon the first day of November, one thousand nine hundred and fifty-eight.

(1A) The regulations may from time to time prescribe rates of remuneration and fees in substi- tution for those prescribed by subsection one of this section and the rates for the time being so prescribed shall be those payable to the chairman and members of the council.

(1B) As from the commencement of the Auctioneers, Stock and Station, Real Estate and Business Agents (Amendment) Act, 1965, "meet- ing of the council" in subsection one of this section includes a meeting of a committee of the council convened pursuant to subsection three of section fifteen of this Act on a day other than that on which a duly convened meeting of the council is held.

(b) by inserting in subsection three of section fifteen s

after the word "council" where firstly occurring (
the words "and of any committee constituted and

appointed by the council";

(c) (i) by omitting from subsection three of section s

twenty-five the words "such fee as may be ( prescribed" and by inserting in lieu thereof P the words "a fee of five pounds or where some

other fee is prescribed such other fee";

(ii)  by inserting in paragraph (b) of subsection four of the same section after the word "expenses" the word ", remuneration";

(d) (i) by inserting in subsection six of section fifty- s seven after the word "shillings" the words ( "for the issue thereof and an administration

fee of one pound, or where some other adminis-

tration fee is prescribed, such other fee";

(ii)

(ii) by inserting in subsection seven of the same section after the word "shillings" the words "for the issue thereof and an administration fee of one pound, or where some other adminis- tration fee is prescribed, such other fee";

(iii) by inserting in paragraph (b) of subsection nine of the same section after the word "renewed" the words "on payment of a fee of five shillings for the renewal thereof and an administration fee of one pound, or where some other administration fee is prescribed, such other fee";

(iv) by inserting at the end of the same section the following new subsection : —

(10) The administration fee prescribed by or under subsections six, seven and nine of this section shall be transmitted by the clerk of petty sessions to the registrar for payment to the credit of the Auctioneers, Stock and Station, Real Estate and Business Agents Administration Account referred to in subsec- tion four of section twenty-five of this Act.
