126 (@uemslan'b ,,,, ')r· ANNO DECIMO ELIZABETHAE SECUNDAE REGINAE ••••••••••••••••••••••••••••••••••••••••••••••••••• No. 34 An Act to Amend "The Auctioneers, Real Estate Agents, Debt Collectors and Motor Dealers Acts, 1922 to 1960," in certain particulars [ASSENTED TO 4TH DECEMBER, 1961] B E it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title I. (1) This Act may be cited as "The Auctioneers, Real Estate Agents, Debt Collectors and Motor Dealers Acts Amendment Act of 1961." Principal Act (2) " The Auctioneers, Real Estate Agents, Debt Collectors and Motor Dealers Acts, 1922 to 1960," are in this Act referred to as the Principal Act. collective (3) The Principal Act and this Act may be collectively title cited as " The Auctioneers, Real Estate Agents, Debt Collectors and Motor Dealers Acts, 1922 to 1961."
1961 Auctioneers, Etc., Acts Amendment Act 127 2. Section sixteen of the Principal Act is amended- Amendments of s. 16 (a) by omitting subsection (1) and inserting in its stead the following subsections :- " (J) Every person who desires to obtain a real Application estate agent , s 1 1 . cense s h a ll l o d ge wi.t h t h e cler k of the afogrerneta'slestate court within the district in which his sole or principal license place of business is or is proposed to be situated and which is nearest, by the most convenient route, to such sole or principal place of business an application in the form prescribed accompanied, subject to subsection (lA) of this section, by a fidelity bond from the State Government Insurance Office (Queensland) in the sum- (a) in the case of a corporation, of nine thousand pounds; (b) in the case of a person other than a corporation who proposes to act as or carry on business as a real estate agent in partnership with another person, of four thousand five hundred pounds; or (c) in the case of any person other than a corporation who is not a person specified in paragraph (b) of this subsection, of six thousand pounds. (IA) Where the application for a license pursuant to subsection (1) of this section is the holder of a license of some other class or description for the period for which he is applying for a license as a real estate agent, the fidelity bond by which the application is accompanied may be in the sum equal to the difference between the sum specified in that subsection (1) as would but for this subsection be applicable to the case and the sum in which the obligor under the fidelity bond lodged in respect of that other license and in force in respect of the period for which the applicant is applying for the license as a real estate agent, undertakes by that bond to be bound." ; (b) by omitting from subsection (4A) the words ", and (if the applicant is not an auctioneer licensed for the period for which he is applying for the renewal of his license as a real estate agent) accompanied by " and inserting in their stead the words " accompanied, subject to subsection (4B) of this section, by the fidelity bond or " ; and
128 Auctioneers, Etc., Acts Amendment Act (c) by inserting after subsection (4A) the following subsection :- "(4B) Where the applicant for renewal of a license pursuant to subsection ( 4A) of this section is the holder of some other class or description of license for the period for which he is applying for the renewal of a license as a real estate agent, the fidelity bond by which the application is accompanied or to which the certificate of renewal in the prescribed form accompanying the application relates may be in the sum which, if the application were an application under subsection (1) of this section, would pursuant to subsection (IA) of this section be permissible in the case."
