This Act may be cited as "The Auctioneers and Short title Commission Agents Acts Amendment Act of 1936," and : ~ : struction.

No. 2, shall be read as one with *"The Auctioneers and Commission Agents Acts, 1922 to 1924," hereinafter referred to as the Principal Act. The Principal Act and this Act may collectively be cited as "The Auctioneers and Commission Agents Acts, 1922 to 1936." Commence- 2. This Act shall commence and come into force ment of Act. on the first day of January, one thousand nine hundred and thirty-seven. Amendments of the Principal Act. oAfms. en 4 d . ment follow 3 s . : S-ection four of the Principal Act is amended as (a) The definition "Auctioneer" is amended by inserting therein, after the word" property," the words " whether the property of the auctioneer or of any other person." (b) The definition " Commission agent " is repealed and the following new definition inserted in lieu thereof, namely- Commission agent. " "Commission agent "-Any person who within a district in which the provisions of this Act relating to commission agents are in force- (a) Is a motor dealer; or (b) As an agent for others, and whether on commission or for or in expectation of any fee, gain, or reward, and either alone or in connection with any other business, and either generally or in respect of any one transaction, exercises or carries on the business or advertises or notifies that he exercises or carries on the business of buying, selling, or letting houses, land, or estates, or negotiating for such buying, selling, or letting, or buying, selling, or letting hotel businesses, boarding-house businesses, store-keeping businesses, manu- facturing businesses, or trading businesses whatsoever, or any interest in any of such businesses or buying or selling live stock or collecting debts: the term does not include a person employed merely as a * 13 Geo. Auctioneers! and Commission Agents, Etc., Act. ------------------------- clerk or servant, or any registered banking or life assurance company, or any trustee company, or friendly society, or building society, or the Public Curator, or any of his deputies." (c) The following new definitions are inserted therein, after the definition" Minister," namely :- " " Motor dealer "-Any person who- dMeoatloerr. (a) On his own behalf, and either alone or in connection with any other business, exercises or carries on the business or advertises or notifies that he exercises or carries on the business of buying or selling (including the letting or selling upon a hire-purchase agreement within the meaning of *"The Hire-purchase Agreement Acts, 1933 to 1934 "), used or second-hand motor vehicles, and/or (b) As an agent for others, and whether on commission or for or in expectation of any fee, gain, or reward, and either alone or in connection with any other business, and either generally or in respect of anyone transaction, exercises or carries on the business, or advertises or notifies that he exercises or carries on the business, of buying or selling (including the letting or selling upon a hire-purchase agreement within the meaning of *" The Hire-purchase Agreement Acts, 1933 to ]934 "), used or second-hand motor vehicles; "Motor vehicle "-Any vehicle propelled by gas, Mot.or motor spirit, oil, electricity, steam, or any vehICle. other motive power, and used or intended to be used on any public highway either with or without bodies or other additions thereto : the term includes motor bicycle or motor cycle, but does not include a railway or tramway locomotive, tram motor, tram car, fire engine, fire reel, or traction engine." 4. Subsection three of section seven of the Principal.!lmendment Act is hereby amended by the insertion in the first of s. 7 (3). paragraph thereof, after the word "applicant," where 14602 a * n 2 d 4 1 G 5 e 0 o 5 . 3. v. No. 2, such word first occurs, of the words "is of good fame and character and otherwise"; and by the addition thereto of the following new paragraphs, namely :- " Provided further, that the registrar or any person authorised by the Minister may appear and be heard (and either in person or by his counsel or solicitor) on the hearing of any application under this section: Provided moreover, that the court or the clerk of the court may refer any application for a license to the registrar and, in any such case, the registrar shall investigate the application so referred to him and may recommend or oppose the granting' of the license accordingly." Amendment 5. Section twelve of the Principal Act is hereby of B. 12. amended, as follows :-- (a) Subsection two of the said section is repealed and the following new subsections are inserted in lieu thereof, namely :- "(2.) No auctioneer shall pay to his general trust account any moneys other than moneys received by him in respect of a sale by auction or, where he is a licensed commission agent as well as an auctioneer, in respect of a transaction as a commission agent, and no auctioneer shall pay to a separate trust account any moneys other than moneys received by him in respect of a sale or, where he is a licensed commission agent as well as an auctioneer, in respect of a transaction for which such account was established. (3.) Every auctioneer shall, within fourteen days of demand in writing made by the person on whose behalf the property was sold, and, in any event, within forty-two days after the receipt of money in respect of any sale, pay the balance of such money (if any) to the person on whose behalf the property was sold, or as he may direct." (b) Subsection four of the said section is amended by the addition thereto of the words "and moreover the adjudicating court may, if it thinks the circumstances of the offence so warrant, suspend the license of the offender for such period as it shall deem proper or cancel such license." (c) Subsections three, four, and five of the said section are renumbered four, five, and six respectively.

Subsection one of section thirteen of the Principal Amendment Act is hereby amended by repealing the words "thirty of 8. 13 (1). days" and by inserting in lieu thereofthe words" fourteen days of demand in writing made by the person on whose behalf the property was sold, and, in any event within forty-two days." 7 . Paragraph (c) of section fifteen of the Principal Amendment Act is hereby repealed and the following new paragraph of s. 15. (c) is inserted in lieu thereof, namely:- "(c) Such fees, charges, commission, reward, .or other remuneration are included in and not in excess of the prescribed fees, charges, commission, reward, or other remuneration for or in respect of such transaction, where same have been prescribed." 8. The following new sections are inserted after New ss. 15A section fifteen of the Principal Act, namely:-' and 15B.. Upon conviction for an offence against this section the adjudicating court shall order the auctioneer concerned to refund any excess or improper fees, charges, commission, reward, or other remuneration received or retained by him. No. 2, prescribed, or whereby any person agrees to waive or surrender any right or remedy which he may have in respect of any such excess or improper fees, charges, commission, reward, or other remuneration received or retained by an auctioneer, or, in any event any covenant, agreement, or condition whereby any person agrees to waive or surrender any right or remedy which he may have against an auctioneer under and in pursuance of this Act shall be absolutely void and of none effect whatsoever." Amendment 9. Subsection three of section sixteen of the Principal of s. 16 (il). Act is hereby amended by the insertion, after the word "applicant," where such word first occurs in the first paragraph thereof, of the words" is of good fame and character and otherwise"; and by the addition thereto of the following new paragraphs, namely:- " Provided further, that the Minister or any person authorised by the Minister may appear and be heard (and either in person or by his counsel or solicitor) on the hearing of any application under this section. " Amendment 10. Section twenty of the Principal Act is hereby of s. 20. amended, as follows :_ (a) Subsection two of the said section is repealed and the following new subsections are inserted in lieu thereof, namely :- "(2.) No commission agent shall pay to his general trust account any moneys other than moneys received by him in respect of a transaction as commission agent or, where he is a licensed auctioneer as well as a commission agent, in respect of a sale by auction, and no commission agent shall pay to a separate trust account any moneys other than moneys received by him in respect of a transaction or, where he is a licensed auctioneer as well as a commission agent, in respect of a sale for which such account was established. (3.) Every commission agent shall, within fourteen days of demand in writing made by the person on whose

(b) Subsection four of the said section is amended by the addition thereto of the words" and moreover the adjudicating court may, if it thinks the circumstances of the offence so warrant, suspend the license of the offender for such period as it shall deem proper or cancel such license." (c) Subsections three, four, and five of the said section are renumbered four, five. and six respectively. 11. Subsection one of section twenty-one of the Amendment Principal Act is hereby amended by repealing the words of s. 2l. "thirty days" and by inserting in lieu thereof the words "fourteen days of demand in writing made by the person on whose behalf the transaction was carried out, and, in any event within forty-two days." 12. Section twenty-three of the Principal Act is Amendment hereby amended, as follows :- of s. n. (a) In paragraph (b) of the said section the words " act as agent " are repealed and the words "act as commission agent " are inserted in lieu thereof. (b) Paragraph (c) of the said section is repealed and the following new paragraph is inserted in lieu thereof, namely :- "(c) Such fees, charges, commission, reward, or other remuneration are included in and not in excess of the prescribed fees, charges, commission, reward, or other remuneration for or in respect of such transaction, where sanie have been prescribed." 13. The following new sections are inserted after New ss. 2;h section twenty-three of the Principal Act, namely:- and 23B. " [23A. ] Where the fees, charges, commISSIOn, Offence to reward, or other remuneration which a commission agent demand shall be entitled to receive for or in respect of any service f~ ~ ~ ~ sp~ ~ or transaction are prescribed, any commission agent who, ~ ~muncra­ for or in respect of such service or transaction demands, .on. receives, or retains from any moneys received by him an amount by way of fees, charges, commission, reward,

No. 2, or other remuneration which is in excess of or not included in the fees, charges, commission, reward, or other remuneration, as the case may be, so prescribed, shall be guilty of an offence and liable to a penalty of not more than fifty pounds or less than five pounds. Upon conviction for an offence against this section the adjudicating court shall order the commission agent concerned to refund any excess or improper fees, charges, commission, reward, or other remuneration received or retained by him. Prohibition [23B.] Where the fees, charges, commission, reward, o co f ntracting- or other remuneration which a commission agent shall be out. entitled to receive for or in respect of any service or transaction are prescribed, any covenant, agreement, or condition whereby any person agrees to payor allow to a commission agent any amount by way of fees, charges, commission, reward, or other remuneration which is in excess of or not" included in the fees, charges, commission, reward, or other remuneration, as the case may be, so prescribed, or whereby any person agrees to waive or surrender any right or remedy which he may have in respect of any such excess or improper fees, charges, commission, reward, or other remuneration received or retained by a commission agent, or, in any event, any covenant, agreement, or condition whereby any person agrees to waive or surrender any right or remedy which he may have against a commission agent under and in pursuance of this Act shall be absolutely void and of none effect whatsoever." New ss. 24A, 14. The following new sections are inserted, before a24nBd, 2244D0. , section twenty-five of the Principal Act, under the heading "General Provi8ion8," namely;- False "[24A.] Any auctioneer or commission agent who trieopnrsesaesnttao- makes to any purchaser or prospective purchaser any property by false representation concerning any real or personal auctio~ e~ r or property which he has for sale by auction or as acogmenmt. lSSlOn commIS . SI On agent ,as the case may be, sha11 be gU.Ilty of an offence and liable to a penalty of not more than one hundred pounds and, in addition, the adjudicating court may cancel or suspend for such time as to it appears fit the license of the offending auctioneer or commission agent.

Ornecaegiveend t aocogrmenmtIS.faS.iIlOinng who has been ordered by any court or justice to pay to t~ ~ om~ y any person any moneys received by him in respect of a WIt or er. transaction shall, if such auctioneer or commission agent fails to pay to the person concerned the moneys so ordered to be paid within the time specified in the order, or, if no time is specified in the order then within fourteen days after the making of the order, be guilty of an offence and liable to a penalty of not more than one hundred pounds and in addition to have his license cancelled or suspended for such time as it thinks fit by the adjudicating court. A conviction for an offence against this section shall not prejudice or affect any right or remedy which any person may have against the offending auctioneer or commission agent under or in pursuance of any such order as aforesaid. [240.J Where the license of an auctioneer or Notification commission agent is cancelled or suspended by a court, of II t' the registrar or clerk of such court shall notify the ~ ~ nce a IOn registrar thereof within seven days of the making of such suspension cancellation or suspension, as the case may be. [24n.J The Minister shall have full power and 'When bond authority to forfeit the fidelity bond or other prescribed ro: lei~ : d. security of any licensee who in his opinion has committed an offence against this Act, notwithstanding that such licensee has not been convicted of the offence, or has died, or has absconded, or has left the State." 15. Section twenty-five of the Principal Act is ~ mendment hereby amended by the addition thereto of the following 0 s. 25. new subsection, namely:- "(5.) The register shall be open for inspection Register between the hours of ten 0' clock in the forenoon and four iJs~ ~ c~ ~ ~n. o'clock in the afternoon of any week-day except Saturday, and between the hours of ten o'clock in the forenoon and twelve o'clock noon on Saturday."

Principal Act is hereby repealed and the following new subsection is inserted in lieu thereof, namely :- Notification "(2.) Every licensee who changes his registered ~~ ~ ~ e~ ~ ~ e of office shall, within fourteen days of making such change, notify the clerk of the court of the address to which he has so changed such registered office, and the clerk shall within fourteen days after the receipt by him of such notice inform the registrar of the change of address. The registrar shall enter in the register of licenses every change of address of which he has been so informed. Any licensee who fails to comply with the provisions of this subsection shall be guilty of an offence." Amendment 17. Section thirty-one of the Principal Act is of s. 31.' hereby amended by the addition thereto of the following new subsection, namely:- "(4.) Where the Supreme Court is of opinion that any licensee who is a party to any proceeding before such court is not a fit and proper person to hold a license under this Act, the court may order- (a) That the license or licenses held by such person be cancelled and delivered up to the court; and (b) That the licensee whose. license or licenses is or are so cancelled be disqualified, and either permanently or for such period as the court in its discretion may order from holding any license or licenses under this Act." Amendment 18. Section 3lA of the Principal Act is hereby of s. 31A. amended as follows, namely : - (a) The first paragraph of the said section is amended by repealing the words "any books accounts registers documents or writings relating to any sale or transaction under this Act" and by inserting in lieu thereof the words" all or any books, accounts, registers, documents, or writing relating to his business as a licensee, and shall answer all questions put to him concerning such business." (b) The third paragraph of the said section is amended by the insertion therein, after the word " extrac.ts," of the words " or who wilfully gives a false answer to any such question as aforesaid."

(c) The following paragraph is added to the said section, namely :- " This section shall apply and extend to any person who has the custody or possession of any book, account, register, document, or writing which relates to the business of a licensee." 19. The following new section is inserted after New s. 31a. section 3lA of the Principal Act namely:- " [31B.] (1.) The Auditor-General at the request of Po,,:er of the Minister may examine and/or audit, and the Minister ~ ~ ~ ~ s 0;£ may on his own initiative cause any officer of the Public licensee. Service or any accountant appointed by the Minister in that behalf to examine and/or audit, the books and accounts of any licensee, and for the purposes of such audit and/or examination the Auditor-General, or any officer, or any accountant so appointed may examine any books, accounts, and documents relating to such accounts, and may make and take away with him any extract from any book or copy of any such documents. (2.) If any person obstructs the Auditor-General, or any officer, or any accountant so appointed in the exercise of his powers or the performance of his duties under this section, or without lawful excuse refuses to produce any book, account, document, writing, paper, or instrument in his possession or under his control, or to permit the making and taking away of any extract from any book or copy of any document, or to answer any question asked by the Auditor-General, or such officer, or such accountant so appointed for the purpose of the exercise of such powers or the performance of such duties he shall be liable to a penalty of not less than two pounds or more than twenty pounds; and if any person after conviction for any such offence still refuses to produce any such book, account, document, paper, writing, or instrument, or to permit the making and taking away of any extract or copy, or to answer any such question he shall be liable to a further penalty not exceeding twenty pounds for each and every day during which such default continues. (3.) It shall be the duty of every manager or other principal officer of any bank with which a licensee has deposited any moneys, whether in his own account or in any general or separate trust account, to disclose every such account to the Auditor-General or to any officer or to any accountant so appointed upon demand made by the Auditor-General, or any officer, or any accountant

Ko. 2, so appointed, and to permit the Auditor-General, or any officer, or any accountant so appointed to make and take away with him an extract from any book or copy of any such accounts, or copy of any document or writing relating to such accounts. Any manager or principal officer of such bank as aforesaid who knowingly acts contrary to the provisions of this subsectionshall be liable to a penalty of not more than one hundred pounds. (4.) This section shall apply and extend to any person having the custody or possession of any book, account, register, document, or writing of a licensee." Amendment 20. Subsection one of section thirty-four of 'the of s. 34. Principal Act is hereby amended by the addition thereto of the following new paragraph, namely:- "Any such proceeding may be instituted within six months after the offence is committed or within six months after the discovery of the offence by the complainant, whichever is the later period." New s. 34A. 21. The following new section is inserted after section thirty-four of the Principal Act, namely:- Cancellation "[34A.] Where the registrar is satisfied that a license iolflelgicaellnyse has been issued to an applicant who has not discharged obtained. in full all of the provisions which this Act requires such applicant to discharge preliminary to the grant of such license, the registrar may, by complaint under *"The Jus#ces Acts, 1886 to 1932," call upon such person to show cause to the court why such license should not be cancelled. If the court, on the hearing of any such complaint, is satisfied that the applicant to whom the license was issued failed to discharge in full any such provision as aforesaid, the court may order that the license be cancelled and delivered up to it." Amendment 22. Section thirty-five of the Principal Act is of s. 35. hereby amended as follows, namely- (a) Subparagraph (vii.) of the second paragraph thereof is repealed and the following new subparagraphs are inserted in lieu thereof, namely:- "(vii.) Prescribing the fees, charges, commission, reward, or other remuneration that auctioneers ... 50 Vic. No. 17 and amending Act,s, 8upra, pages 1132 et seq.

Auctioneers and Commission Agents, Etc., Act. ~ - - - - - - - - - - - - ~ ~ - ~ - - - - - -- ~ ~ - and commission agents shall be entitled to receive for or in respect of the services or transactions carried out by them, and the maximum amount thereof: Provided that the fees, charges, commission, reward, or other remuneration so prescribed may be uniform for or in respect of all districts or - for or in respect of all services or transactions of an auctioneer or commission agent, or may be varied for or in respect of different districts, or for or in respect of different services, or transactions or classes of services or transactions as an auctioneer or commission agent; (viii.) The books, accounts, and records to be kept by licensees, and the form and manner of keeping same, and the exemption by the registrar from keeping any prescribed book, account, or record· of any licensee who in the opinion of the registrar keeps books, accounts, or records, as the case may be, sufficient for the purposes of this Act, and the revocation by the registrar of any such exemption; (ix.) With respect to all or any of the following matters- (a) Providing for an audit of the trust accounts and, if necessary, the business accounts of licensees or specified classes of licensees, and for the furnishing of a report of the result of any such audit, (b) Requiring the production to the auditor by the licensee, his servants or agents, or by the manager or person in charge of any bank of books, papers, and accounts relating to the business of a licensee, subject to prescribed conditions, (c) Prescribing the persons to whom the reports of auditors shall be sent for inspection, information, or record, (d) Providing -that the auditor shall be subject; to an obligation not to divulge, otherwise than as prescribed, any matter of which he .shall be informed in the course of the audit,

(e) Prescribing a scale of fees to be paid for suuh audit, (f) Prescribing that in the absence of any agreement in writing to the contrary the audit fees shall be paid by the licensee; (x.) Fees for inspection of the register and for the making and supply of any copy or extract therefrom. " (b) The existing subparagraphs (viii.) to (x.), both inclusive, of the second paragraph of the said section are renumbered (xi.) to (xiii.), respectively. AUDIT ACTS AMENDMENT.
