This regulation may be cited as the Auctioneers and Agents (Exemptions) Amendment Regulation (No. 3) 1997 . ˙ Regulation amended 2. This regulation amends the AuctioneersandAgents(Exemptions)Regulation 1995 . ˙ Renumbering of s 3 (Exemption for obtaining provisional auctioneer’s licence) 3. Section 3— renumber as section 5. ˙ Insertion of new ss 3 and 4 4. After section 2— insert— ˙ ‘ Exemption for obtaining corporation licence—Bayersville Resource Recovery Centre Inc ‘ 3.(1) Bayersville Resource Recovery Centre Inc ( “Bayersville” ) is exempted from sections 19(3)(a), (b) and (c) and 125 of the Act. ‘ (2) The exemption applies only for the business of Bayersville, on its own behalf, acquiring used motor vehicles from a Mackay City Council refuse facility and— (a) breaking them up for sale, piecemeal; or (b) selling them piecemeal. ‘ (3) The exemption is on the following conditions— (a) Bayersville’s only place of business will at all times be at Mackay; (b) either—
s4 3 s4 Auctioneers and Agents (Exemptions) Amendment (No. 3) No. 402, 1997 (i) the person in charge of the place of business must be a member of Bayersville’s management committee; or (ii) if the person in charge of the place of business is not a member of the management committee—a member of the management committee who holds an appropriate licence must adequately supervise the conduct of the business of Bayersville mentioned in subsection (2). ‘ (4) The exemption is suspended for any period during which Bayersville is contravening a condition. ‘ (5) In this section— “appropriate licence” means a motor dealer’s licence under which the person may act as a motor dealer for the business mentioned in subsection (2). “management committee” , of Bayersville, means Bayersville’s management committee under the AssociationsIncorporationAct 1981 . ˙ ‘ Exemption for obtaining corporation licence—Commander Credit and Collection Company Pty Ltd ‘ 4.(1) Commander Credit and Collection Company Pty Ltd ACN 001 710 025 ( “Commander” ) is exempted from section 19(3)(b) of the Act. ‘ (2) The exemption applies only for the business of a commercial agent. ‘ (3) The exemption is on the following conditions— (a) Commander must comply with its undertaking dated 1 July 1996 addressed to the Department of Consumer Affairs and as if it were addressed to the State; (b) if the Act requires money received by Commander to be paid into a general trust account with an approved financial institution, the money must be paid into a general trust account in Queensland with an approved financial institution. ‘ (4) The exemption is suspended for any period during which Commander is contravening a condition.’.
