This regulation may be cited as the Auctioneers and Agents (Exemptions) Amendment Regulation (No. 1) 1999 . ˙ Regulation amended 2. This regulation amends the AuctioneersandAgents(Exemptions)Regulation 1995 . ˙ Insertion of new ss 5DA-5DD 3. After section 5D— insert— ˙ ‘ Exemption for obtaining corporation licence—Gandel Asset Management Pty. Ltd. ‘ 5DA.(1) Gandel Asset Management Pty. Ltd. ACN 060 482 635 is exempted from the part of section 19(3)(b) of the Act allowing the grant, renewal or restoration of a corporation licence to a corporation only if a director of the corporation is resident in this State. ‘ (2) The exemption only applies for the business of a real estate agent. ˙ ‘ Exemption for obtaining corporation licence—GE Capital Asset Services & Trading Asia Pacific Pty. Limited ‘ 5DB.(1) GE Capital Asset Services & Trading Asia Pacific Pty. Limited ACN 078 961 118 is exempted from the part of section 19(3)(b) of the Act allowing the grant, renewal or restoration of a corporation licence to a corporation only if a director of the corporation is resident in this State. ‘ (2) The exemption only applies for the business of an auctioneer. ˙ ‘ Exemption for obtaining corporation licence—Orix Australia Corporation Limited ‘ 5DC.(1) Orix Australia Corporation Limited ACN 002 992 681 is exempted from the part of section 19(3)(b) of the Act allowing the grant,

s4 4 s4 Auctioneers and Agents (Exemptions) Amendment (No. 1) No. 182, 1999 renewal or restoration of a corporation licence to a corporation only if a director of the corporation is resident in this State. ‘ (2) The exemption applies only if the conditions mentioned in subsection (3) are imposed, under section 26(10) 1 of the Act, and with or without other conditions, as conditions of the corporation licence. ‘ (3) The conditions for the licence are the following— (a) the only class of business that the corporation is authorised to carry on under the licence is the business of a motor dealer; (b) in carrying on the business as a motor dealer, the corporation is restricted to— (i) selling “off-lease” motor vehicles owned by the corporation; and (ii) acquiring or selling motor vehicles acquired by the corporation as “trade-ins” in the ordinary course of selling the vehicles mentioned in subparagraph (i). ˙ ‘ Exemption for obtaining corporation licence—The Queensland Branch of Australia Medical Association ‘ 5DD.(1) The Queensland Branch of the Australian Medical Association ACN 009 660 280 is exempted from the part of section 19(3)(b) of the Actallowing the grant, renewal or restoration of a corporation licence to a corporation only if a director of the corporation is resident in this State. ‘ (2) The exemption applies only for the business of a commercial agent.’. ˙ Replacement of s 7 (Exemption for making claim against fund—Alan James Harwood) 4. Section 7— omit, insert— 1 Section 26 (Grant of licence) of the Act

s4 5 s4 Auctioneers and Agents (Exemptions) Amendment (No. 1) No. 182, 1999 ˙ ‘ Exemption for obtaining motor dealer’s licence—Bruce James Williams ‘ 7.(1) Bruce James Williams of unit 8, 10 Angus Avenue, Epping, New South Wales is exempted from section 57(1)(a) 2 of the Act. ‘ (2) The exemption applies only if the condition mentioned in subsection (3) is imposed, under section 26(10) 3 of the Act, and with or without other conditions, as a condition of the motor dealer’s licence. ‘ (3) The condition for the licence is that Bruce James Williams remains a director of Orix Australia Corporation Limited ACN 002 992 681.’. ˙ ‘ Exemption for making claim against the fund—William Levi Clare ‘ 8.(1) William Levi Clare, c/o Witheriff Nyst, Solicitors, 13 Nerang Street, Southport, Queensland (the “ claimant ”) is exempted from section 119(5) of the Act. ‘ (2) This section applies only for making a claim for $17,600.00 against the fund in relation to a motor vehicle purchased by the claimant on 28 October 1996 from Brian Gurney, trading at the time of the transaction as Gurney Wholesale, of 3 Lae Street, Beenleigh, Queensland, and now the holder of the appropriate licence for Mr. Terms Auto Sales Pty Ltd ACN 081 214 511 of 15 Old Pacific Highway, Yatala, Queensland. ‘ (3) This section expires on 1 December 1999. ˙ ‘ Exemption for making claim against the fund—Donal Francisco Doolan ‘ 9.(1) Donal Francisco Doolan of 33 Pinkwood Street, Bellbowie, Queensland (the “ claimant ”) is exempted from section 119(5) of the Act. ‘ (2) This section applies only for making a claim for $89, 000.00 against the fund in relation to unit 24, Quay Terraces at 7 Boundary Street, City, Brisbane, Queensland purchased by the claimant off the plan through PRD Realty Pty Ltd ACN 009 954 956 of 62-64 Appel Street, Surfers Paradise, 2 Section 57 (Motor dealers’ licences) of the Act 3 Section 26 (Grant of licence) of the Act

s4 6 s4 Auctioneers and Agents (Exemptions) Amendment (No. 1) No. 182, 1999 Queensland on 26 November 1993. ‘ (3) This section expires on 1 December 1999. ˙ ‘ Exemption for making claim against the fund—Ronald John Hurst and Leanne Merle Hurst ‘ 10.(1) Ronald John Hurst and Leanne Merle Hurst of 24 Jenalyn Crescent, Bundaberg, Queensland (the “ claimants ”) are exempted from section 119(5) of the Act. ‘ (2) This section applies only for making a claim for $4,090.00 against the fund in relation to a motor vehicle purchased by the claimants from Ian Shorland Fairhill, trading as Southern Motors Wholesale, of 4 Rannock Avenue, Benowa Waters, Queensland on 14 December 1995. ‘ (3) This section expires on 1 December 1999. ˙ ‘ Exemption for making claim against the fund—Robert Fraser McNeill ‘ 11.(1) Robert Fraser McNeill of 18 Hume Court, Boronia Heights, Queensland (the “ claimant ”) is exempted from section 119(5) of the Act. ‘ (2) This section applies only for making a claim for $8,100.00 against the fund in relation to a motor vehicle purchased by the claimant from Michael John Hawton of 301 Redland Bay Road, Capalaba, Queensland on 10 July 1995. ‘ (3) This section expires on 1 December 1999.’.
