This regulation may be cited as the Auctioneers and Agents (Exemptions) Amendment Regulation (No. 1) 1998 . ˙ Regulation amended 2. This regulation amends the AuctioneersandAgents(Exemptions)Regulation 1995 . ˙ Renumbering of s 5 (Exemption for obtaining provisional auctioneer’s licence) 3. Section 5— renumber as section 8. ˙ Insertion of new ss 5–7 4. After section 4— insert ˙ ‘ Exemption for obtaining corporation licence—James R Lawson Pty Ltd ‘ 5.(1) James R Lawson Pty Ltd ACN 000 055 176 is exempted from the part of section 19(3)(b) of the Act that allows the grant, renewal or restoration of a corporation licence only if a director of the corporation is resident in this State. ‘ (2) The exemption only applies for the business of an auctioneer. ˙ ‘ Exemptions for obtaining restricted auctioneers licences ‘ 6.(1) The following persons are exempted from section 41(4)(a) of the Act— • Eddie Ray Graham, RR# 1, Marlow, Oklahoma, USA • Richard James Horn, 1806 Fifth Street, Nisku, Alberta, Canada • Darrel Delmer Yoder, 14546 State Highway, Lyons, Ohio, USA

s4 3 s4 Auctioneers and Agents (Exemptions) Amendment (No. 1) No. 3, 1998 • Wayne Eugene Yoos, SS#2, Site 1, Compartment 106, Kamloops, British Columbia, Canada. ‘ (2) Each exemption applies only for the granting of a restricted auctioneers licence under which the holder is only authorised to conduct sales by auction on behalf of Ritchie Bros Auctioneers (Overseas) Ltd ARBN 065 858 586 ( “Ritchie Bros” ) or the renewal or restoration of the licence. ‘ (3) Each exemption is on the condition that the person— (a) may only conduct an auction on Ritchie Bros’ behalf while Ritchie Bros holds a corporation licence under which it is authorised to act as an auctioneer for the auction; and (b) must not receive, hold or deal with any money in relation to a sale conducted by the person under the restricted licence. ‘ (4) The exemption is suspended for any period during which the person is contravening a condition. ˙ ‘ Exemption for making claim against fund—Alan James Harwood ‘ 7.(1) Alan James Harwood of 36 Princess Street, Bundaberg is exempted from section 119(5) of the Act. ‘ (2) The exemption applies only for the making of a claim for $575.00 against the fund in relation to 23 aluminium windows asserted to belong to Mr Harwood and to have been consigned to Burnett Auctions Pty Ltd ACN 061 351 442 for sale by auction on or about 6 April 1995.’.
