s1 2 s3 Auctioneers and Agents Amendment (No. 3) No. 154, 1997 ˙ Short title 1. This regulation may be cited as the Auctioneers and Agents Amendment Regulation (No. 3) 1997 . ˙ Regulation amended 2. This regulation amends the Auctioneers and Agents Regulation 1986 . ˙ Amendment of s 18 (Applications for real estate agents’ licences) 3.(1) Section 18(1)(a)(i), (d)(i) and (e)(i)— omit. (2) Section 18(1)(a)(ii), (d)(ii) and (e)(ii), from ‘in the case of’ to ‘1988,’— omit . (3) Section 18— insert (1A) Instead of complying with subsection (1), the applicant may give the committee satisfactory evidence from a training entity that the applicant— (a) has successfully completed each of the national real estate curriculum modules approved under the Australian National Training Authority Act 1992 (Cwlth) and stated in schedule 7; or (b) has otherwise been assessed as competent in each of the modules; or (c) has— (i) successfully completed some of the modules; and (ii) otherwise been assessed as competent in the remaining modules.’. (4) Section 18— insert (3) In this section—
s4 3 s5 Auctioneers and Agents Amendment (No. 3) No. 154, 1997 “training entity” means— (a) a State college within the meaning of the Vocational Education,Training and Employment Act 1991 ; 1 or (b) another entity registered to provide courses, training programs or short courses under that Act. 2 ’. ˙ Amendment of sch 3 4.(1) Schedule 3, heading— omit, insert— SCHEDULE 3 COMMISSION AND OTHER AMOUNTS PAYABLE TO AUCTIONEERS, REAL ESTATE AGENTS, MOTOR DEALERS AND COMMERCIAL AGENTS section 56’. (2) Schedule 3, item 2(a)(iii), column 2, paragraph (iv), from ‘the sum’ to ‘$400’— omit, insert ‘5% of the gross proceeds of sale’. ˙ Insertion of new sch 7 5. After schedule 6— 1 The Vocational Education, Training and Employment Act 1991 , section 4 defines “State college” as meaning— (a) any State college or other means of technical and further education; and (b) any State senior college continued or established under this Act. 2 See the VocationalEducation,TrainingandEmploymentAct1991 , section 20 (Functions and powers of Accreditation Council)
