AUCTIONEERS AND AGENTS ACT 1941 - REGULATION
(Relating to the commencement of the Community Land
Development Act 1989)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Auctioneers and Agents Act 1941 has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 August 1990.
Amendments
2. The Auctioneers and Agents Regulations are amended:
| (a) | by inserting in Regulation 2 before the definition of "registered office" the following definition: |
"community association, precinct association or neighbour-
hood association'' means an association constituted under the
Community Land Development Act 1989;
| (b) | by inserting in Regulation 54A after the words "strata managing agent" wherever occurring the words "or community managing agent"; |
| (c) | by inserting in Regulation 54A after the words "strata body corporate" wherever occurring the words ", community association, precinct association or neighbourhood association"; |

(d) by inserting in Regulation 55 (iva) after the words "strata managing agent" wherever occurring the words "or community managing agent"; (e) by inserting after Regulation 55 (iva) (b) the following paragraph:
(b1) where the payment is in respect of a contribution referred to in clause 13 of Schedule 1 to the Community Land Management Act 1989, the fact that it is made in respect of that contribution, a statement identifying the land or premises in respect of which the liability to make the contribution is imposed and, if the contribution is a regular periodic contribution, the period in respect of which it is made;
(f) by inserting in Regulation 55 (iva) (d) after the words "strata body corporate'' the words ", community association, precinct association or neighbourhood association"; (g) by inserting in Regulation 57 (iii) (a) after the words "strata managing agent'' the words "or community managing agent"; (h) by inserting in Regulation 57 (iii) (a) after the words "strata body corporate'' the words ", community association, precinct association or neighbourhood association"; (i) by inserting in Regulation 58 (iii) after the words "strata managing agent" where firstly occurring the words "or community managing agent";
(j)
by inserting in Regulation 58 (iii) after the words "strata body corporate'' wherever occurring the words ", community association, precinct association or neighbourhood association";
(k)
by inserting in Regulation 58 (iii) after the words "strata scheme" the words ", community scheme, precinct scheme or neighbourhood scheme".
EXPLANATORY NOTE
The object of this Regulation is to amend the Auctioneers and Agents Regulations so as to impose on community managing agents similar duties relating to the keeping of records as are currently imposed on strata managing agents.
