Attorney General Regulations Amendment (Workers Compensation) Regulations 2024

Made by the Governor in Executive Council.

Part 1 – Preliminary1.Citation

These regulations are the Attorney General Regulations Amendment (Workers Compensation) Regulations 2024.

2.Commencement

These regulations come into operation as follows —

• (a)

  Part 1 — on the day on which these regulations are published on the WA legislation website;

• (b)

  the rest of the regulations — on 1 July 2024.

Part 2 – Criminal Procedure Regulations 2005 amended3.Regulations amended

This Part amends the Criminal Procedure Regulations 2005.

4.Regulation 23 amended

In regulation 23:

• (a)

  in paragraph (c) delete “court;” and insert:

   

court.

 

• (b)

  delete paragraph (d).

Part 3 – Fines, Penalties and Infringement Notices Enforcement Regulations 1994 amended5.Regulations amended

This Part amends the Fines, Penalties and Infringement Notices Enforcement Regulations 1994.

6.Regulations 4 and 5 replaced

Delete regulations 4 and 5 and insert:

4. Orders under Workers Compensation and Injury Management Act 2023 s. 207(1) are fines (Act s. 28(1))

For the purposes of paragraph (b) of the definition of fine in section 28(1) of the Act, an order that an employer pay an amount to the General Account under the Workers Compensation and Injury Management Act 2023 section 207(1) is prescribed.

5. Workers Compensation and Injury Management Act 2023 is prescribed enactment (Act s. 31)

For the purposes of section 31(b) of the Act, the Workers Compensation and Injury Management Act 2023 is a prescribed enactment.

Part 4 – Legislation Regulations 2023 amended7.Regulations amended

This Part amends the Legislation Regulations 2023.

8.Regulation 3 amended

Delete regulation 3(e)(iv) and insert:

• (iv)

  the Workers Compensation and Injury Management Act 2023 section 381 or 382;
