Attorney General Regulations Amendment (Road Traffic Infringement Management Reform) Regulations 2024

Made by the Governor in Executive Council.

Part 1 – Preliminary1.Citation

These regulations are the Attorney General Regulations Amendment (Road Traffic Infringement Management Reform) Regulations 2024.

2.Commencement

These regulations come into operation as follows —

• (a)

  Part 1 — on the day on which these regulations are published on the WA legislation website;

• (b)

  the rest of the regulations — on 7 October 2024.

Part 2 – Cross‑border Justice Regulations 2009 amended3.Regulations amended

This Part amends the Cross‑border Justice Regulations 2009.

4.Regulations 100 and 101A deleted

Delete regulations 100 and 101A.

Part 3 – Fines, Penalties and Infringement Notices Enforcement Regulations 1994 amended5.Regulations amended

This Part amends the Fines, Penalties and Infringement Notices Enforcement Regulations 1994.

6.Regulation 3AAA amended

In regulation 3AAA(1)(f) delete “modified penalty;” and insert:

modified penalty or outstanding balance of the modified penalty;

7.Regulation 11 amended

In regulation 11 after “modified penalties,” insert:

outstanding balances of modified penalties,

8.Schedule 1 amended

In Schedule 1 in the item for the Road Traffic (Administration) Act 2008 delete “79”.

9.Schedule 3 amended

• (1)

  In Schedule 3 Form 2 delete “Modified penalty” and insert:

   

Modified penalty/outstanding balance of modified penalty

• (2)

  In Schedule 3 Form 8:

  • (a)

    delete “modified penalty” and insert:

     

  [modified penalty] / [outstanding balance of the modified penalty]

   
  • (b)

    delete “An order to pay or elect was issued under section 17 of the Act” and insert:

     

  [An order to pay or elect was issued under section 17 of the Act] / [A balance payment order was issued under section 17A of the Act]

   
• (3)

  In Schedule 3 Form 10 delete “modified penalty” and insert:

   

[modified penalty] / [outstanding balance of the modified penalty]
