warrant be quashed It may be that for sove purposes the
record w i l l i n c l u d e t h e a f f i d a v i t ( i f any) l ead ing to the war ran t , o r some note of the "evidence on oath" kept by t h e
magis t ra te , bu t i t is confusing and as a genera l p ropos i t ion
wrong to say that: only the "record" can be looked a t , j t i s
we l l e s t ab l i shed by many a u t h o r i t i e s t h a t i f n e c e s s a r y evidence can be received i n the ce r t io ra r i p roceed ings which
goes t o show want of j u r i sd i c t ion . Ha l sbury ' s Laws of
' England, 4th edi t ion, Vol . 11, pa ra . 1559 s t a t e s t h e law as follows
"Where c e r t i o r a r i i s sought on the ground
of e r ror of law on the face of the record,
the cour t w i l l not admit any extraneous
