AN ORDINANCE

To amend the Attachment of Wages Limitation Ordinance 1966.

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administra­ tion) Act 1910.

ATTACHMENT OF WAGES LIMITATION (AMENDMENT)

ORDINANCE 1977

1. This Ordinance may be cited as the Attachment of Wages Limita­
tion (Amendment) Ordinance 1977.*
2. In this Ordinance, " Principal Ordinance " means the Attachment

of Wages Limitation Ordinance 1966.f

3. Section 4 of the Principal Ordinance is amended by omitting the

definition of " cour t " and substituting the following definitions:—

t Ordinance N o . 7, 1966 as amended by N o . 18, 1977.

" 'Board ' means the Industrial Board constituted under the Industrial Board Ordinance 1936 as in force on 18 Sep­ tember 1947;

' c o u r t ' includes a person competent to make an order for the

attachment of a debt;

' dependant ' , in relation to a judgment debtor, means a person to whose maintenance the judgment debtor contributes or is liable to contribute;

'Determinat ion ' means the Metal Trades (A.C.T.) Deter­ mination No. 13 of 1947 as originally made by the Board and as varied from time to t ime;".

4. Section 5 of the Principal Ordinance is amended by omitting
paragraphs (a ) and (b) and substituting the following paragraphs:—
" (a) if the judgment debtor has any dependants—at the rate of
such amount per week as is equal to the amount of the

minimum weekly wage for the time being payable in pur­

suance of the Determination to adult males; or

(b)

if the judgment debtor does not have any dependants—at the rate of such amount per week as is equal to three- quarters of the amount of the minimum weekly wage for the time being payable in pursuance of the Determination to adult males.".
