1. The applicant seeks special leave to appeal from a decision of the Court of Appeal of the Supreme Court of New South Wales (Ward P, Meagher and Gleeson JJA) dismissing the applicant's cross-appeal from a decision of the primary judge (Black J).

2. The application does not raise a question of general principle. Moreover, the conclusions of the Court of Appeal are not attended by sufficient doubt to warrant a grant of special leave.

3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
