JUDGMENT
MR P G LYNCH for the appellant
McPHERSON JA: There are several different but compelling reasons why this appeal should be dismissed. Prominent among them is that the appellant who lodged the appeal was not a party to the proceedings below in which the judgment was given.
Mr Lynch, who appears in this Court for the appellant, consents to the appeal being dismissed with costs. The Court accordingly makes an order to that effect.

CaseChat Overview and Summary
The central legal issues in the appeal revolved around the validity of the assignment of debts from Atlantic 3-Financial (Aust) Pty Ltd to Atlantic 3 Funds Management Limited, and the standing of the appellant to pursue the claim. Specifically, the Court of Appeal needed to determine whether Atlantic 3 Funds Management Limited, as the assignee, had the legal right to bring the action on behalf of Atlantic 3-Financial (Aust) Pty Ltd. Additionally, the court had to consider whether the appellant was a proper party to the appeal given that it was not a party to the original proceedings.
In dismissing the appeal, the Court of Appeal held that the appellant, Atlantic 3 Funds Management Limited, did not have standing to appeal the decision as it was not a party to the original proceedings. The appellant was the assignee of the debt, but the assignment occurred after the judgment was rendered in the District Court. As such, the appellant did not have the legal capacity to bring the appeal. Furthermore, the court noted that the appeal was filed by a party that did not participate in the lower court proceedings, which further undermined its standing to appeal. Consequently, the appeal was dismissed with costs.
