REASONS FOR JUDGMENT
Before the Court is an application by the Dja Dja Wurrung people for orders that four native title determination applications be discontinued without any orders as to costs. Those applications are 6006 of 1998, 6001 of 1999, 6003 of 1999, and 6001 of 2000.
The application arises in the following circumstances. After lengthy negotiations between the applicant, represented by Native Title Services Victoria (NTSV), and the State of Victoria under the Traditional Owner Settlement Act 2010 (Vic) process, an agreement was reached which involved the execution of an Indigenous Land Use Agreement (the ILUA) under the Native Title Act 1993 (Cth) (NT Act).
At a meeting on 16 March 2013, the Dja Dja Wurrung people authorised entry into a settlement, which included the ILUA. The ILUA was executed by the parties on 28 March 2013. The settlement was contingent on registration of the ILUA on the Register of Indigenous Land Use Agreements in accordance with the NT Act.
After execution by the parties, the ILUA was lodged for registration and ultimately registered on 24 October 2013. Clause 14 of the ILUA requires the applicant to withdraw each of the four native title determination applications as soon as practicable after registration of the ILUA.
At the meeting on 16 March 2013, the Dja Dja Wurrung people authorised and directed the applicant to withdraw the four native title determination applications, in accordance with the terms of the ILUA.
An affidavit sworn on 12 December 2013 by Nicholas James Testro, a solicitor employed by NTSV, explained that NTSV has notified the respondents to each of the four applications of this application to the Court for orders that the matter be discontinued with no order as to costs.
In application 6006 of 1998 there are 13 respondents. In applications 6001 of 1999 and 6003 of 1999, there are two respondents, and in application 6001 of 2000, there are approximately 400 respondents.
In summary, a letter was sent to each of the respondents, bar one, enclosing the minutes of proposed consent orders and indicating that if no answer was received to the letter, it would be taken that the particular respondent consented to the orders.
About 40 respondents returned the orders and indicated that they consented to them. Two respondents phoned NTSV and were told that they would be deemed to have consented if they did not indicate to the contrary. Four respondents, it was discovered, are now deceased, and around 20 letters were returned with the notification “return to sender.” Apart from these responses, Mr Testro deposes that no respondent has contacted him or any other staff member of NTSV to indicate that they object to the orders.
At the hearing, Mr Gary Murray appeared for an indeterminate number of people, whom he said form part of the Dja Dja Wurrung clan group, and he indicated in general terms that a number of them objected to the orders being made. Mr Murray also stated that those individuals did not consent to the settlement under the NT Act.
However, the authorisation at the meeting held on 16 March 2013, supersedes such objection.
Further, the ILUA was registered by a delegate of the Native Title Registrar. The Court was told from the bar table that there had been one objection filed by Mr Murray and others against the application to register the ILUA.
By accepting the ILUA for registration the delegate determined that the native title holders had been identified and had authorised the entry into the ILUA (s 24CK of the NT Act). The objectors did not appeal against the registration of the ILUA, the time for doing so having now passed.
In these circumstances, the Court is satisfied that it should make the orders sought. Consequently, in each of the four applications there will be an order that the application is discontinued with no order as to costs.
