2496 Atherton Tableland Maize Marketing Board Poll No. 410, 1993 ˙ Short title 1. This regulation may be cited as the Atherton Tableland Maize Marketing Board Poll Regulation 1993 . ˙ Definitions 2. In this regulation— “Board” means the Atherton Tableland Maize Marketing Board. “prescribed growers” means growers prescribed by section 3 of the Primary Producers’ (Prescription of Growers) Regulation 1993 ; ˙ Conduct of poll 3. A poll of prescribed growers on the question of winding up the Board under section 37 of the Act must be conducted in the way specified in the Schedule.
2497 Atherton Tableland Maize Marketing Board Poll No. 410, 1993 ¡ SCHEDULE CONDUCT OF POLL section 3 ˙ Definitions 1. In this Schedule— “information statement” means information about voting in the poll in the form approved by the returning officer under clause 3(2); “verifying declaration” means a declaration to verify a person’s entitlement to vote in the poll. ˙ Appointment of returning officer 2. The Minister must appoint an officer of the department as returning officer for the poll. ˙ Ballot paper etc. to be used are those approved by returning officer 3.(1) The forms to be used in, or for the purposes, of the poll including the ballot paper and the verifying declaration are the forms approved by the returning officer. (2) The information statement is the statement approved by the returning officer. ˙ Roll of prescribed growers for the poll 4.(1) The returning officer must prepare a roll of all prescribed growers. (2) The roll is to be prepared from— (a) information supplied by the Board; and (b) any other information the returning officer considers relevant in deciding if a person is a prescribed grower.
2498 Atherton Tableland Maize Marketing Board Poll No. 410, 1993 SCHEDULE (continued) ˙ Returning officer to prepare and send ballot paper etc. to prescribed growers 5.(1) The returning officer must prepare and send together, by post, to each prescribed grower on the roll— (a) a ballot paper initialled by the returning officer; and (b) an envelope addressed to the returning officer, on the back of which is a form of verifying declaration for signature by the prescribed grower; and (c) an information statement. (2) Every— (a) ballot paper; and (b) envelope; and (c) verifying declaration; and (d) information statement; posted to a prescribed grower by the returning officer must be in the same form. (3) The returning officer must keep a written count of the number of ballot papers initialled by the returning officer. (4) The returning officer must post all ballot papers by midday on 25 November 1993. ˙ Voting 6.(1) Each prescribed grower is entitled to 1 vote. (2) A vote is to be recorded by— (a) completing the ballot paper in the way required by the instructions on it; and (b) placing the completed ballot paper in the ballot paper envelope; and (c) sealing the ballot paper envelope; and
2499 Atherton Tableland Maize Marketing Board Poll No. 410, 1993 SCHEDULE (continued) (d) signing the verifying declaration; and (e) posting or delivering the ballot paper envelope to the returning officer. (3) A prescribed grower must not make any other mark on the ballot paper. (4) A ballot paper is of no effect unless it is actually received by the returning officer, sealed in its envelope, by the poll closing time. ˙ Returning officer to place sealed ballot envelopes in a secure place 7. The returning officer must place all sealed ballot envelopes received before the poll closing time in a secure place. ˙ Poll closing time 8. The poll closes at midday on 21 December 1993. ˙ Invalid votes 9. A vote is not valid if— (a) the ballot paper is not completed in the way required by the instructions on it; or (b) the ballot paper is marked (by any person) in a way not permitted by this Schedule; or (c) the ballot paper is not initialled by the returning officer; or (d) the verifying declaration is not signed by the prescribed grower; or (e) the returning officer has received more than one ballot paper from the same prescribed grower; or (f) the intention of the voter is not clear on the face of the ballot paper.

Immediately after the poll closing time, the returning officer must— (a) examine the verifying declarations; and (b) examine the ballot papers; and (c) count the number of— (i) prescribed growers on the roll who properly exercised their right to vote; and (ii) valid votes in favour of the question; and (iii) valid votes against the question; and (iv) invalid votes. ˙ Declaration of result 11. At the completion of the count, the returning officer must declare by signed notice given to the Minister and published in the Gazette— (a) the number of— (i) valid votes in favour of the question; and (ii) valid votes against the question; and (iii) invalid votes; and (iv) prescribed growers on the roll; and (b) the percentage of prescribed growers on the roll who have properly exercised their right to vote; and (c) the percentage of valid votes cast in favour of the question.
