Regulations under the Associations Incorporation Act

1Citation

These Regulations may be cited as the Associations Incorporation Regulations.

2Interpretation

In these Regulations a reference to a form by number is a reference to the form so numbered in Schedule 1.

3Requirements relating to documents

The Registrar may refuse to accept an application, notice or other document which, under the Act, is required to be filed or otherwise lodged with him:

  • (a)

    if the document is not on foolscap paper with a margin at least 2 inches wide on the left hand side of each sheet; or

  • (b)

    if the document has been, or appears to the Registrar to have been, altered in any particular.

4Form of notice of intention to apply

For the purposes of section 5 of the Act, Form 1 is prescribed.

5Form of certificates of incorporation

A certificate of incorporation of an association issued by the Registrar under section 8 of the Act shall be in accordance with Form 2.

6Forms relating to changes of name
  • (1)

    An application under section 17(1) of the Act for the issue to an incorporated association of a certificate of incorporation in a new name shall be in accordance with Form 3.

  • (2)

    A certificate of incorporation in a new name issued to an incorporated association by the Registrar under section 17 of the Ordinance shall be in accordance with Form 4.

7Inspection of documents
  • (1)

    The Registrar may permit a person to inspect all or any of the documents filed or otherwise lodged with the Registrar in respect of an incorporated association upon payment to the Registrar of the fee specified in Schedule 2.

  • (2)

    At the request of a person made by post or otherwise, the Registrar may, upon payment to him of the fee specified in Schedule 2, furnish to that person any information in writing in the Registrar’s possession relating to an incorporated association.

8Fees

The fees set out in Schedule 2 shall, in respect of the matters to which they relate, be paid to the Registrar.

9Notice of intention to apply

For the purposes of section 25A(2)(a) of the Act, form 5 is prescribed.

10Form of certificates of incorporation

A certificate of incorporation of a trading association issued by the Registrar under section 25D(1) of the Act shall be in accordance with Form 6.

11Ethnic communities

For the purposes of section 25D(2)(d) of the Act, the ethnic communities specified in Schedule 3 are prescribed.

12Forms relating to changes of name
  • (1)

    An application under section 25Z(1) of the Act for the issue to an incorporated trading association of a certificate of incorporation in a new name shall be in accordance with Form 7.

  • (2)

    A certificate of incorporation in a new name issued to an incorporated trading association by the Registrar under section 25Z(1) of the Act shall be in accordance with Form 8.

For the purposes of section 25AF(2)(a) of the Act the form set out in Form 9 is prescribed.
