Associations Incorporation Amendment

Regulations 2017

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Associations Incorporation
Amendment Regulations 2017.

2.            Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on the day after that day.

3.            Regulations amended

These regulations amend the Associations Incorporation
Regulations 2016.
for service of any process, notice or other document;

4.            Regulation 19 amended

(1) In regulation 19(1) before the 1St alphabetical definition insert in
numerical order:

1987 Act notice means a notice of an address for service lodged under Associations Incorporation Act 1987 section 40;

(2) In regulation 19(1) insert in alphabetical order:

address for service means an address or postal address

(3) In regulation 19(2):

(a) delete paragraph (a) and insert:

(a) before the commencement day the association

lodged a 1987 Act notice; and

(b) in paragraph (b) before "notice" insert:

1987 Act

(4) After regulation 19(2) insert:

(3) Where an existing incorporated association has not

lodged notice of an address for service under the

Act—

(a)

notice most recently lodged by the association
before the commencement day is taken for the
purposes of section 176 of the Act to have been

the address for service given in the 1987 Act section 174; or

(b)

if the association has not lodged a 1987 Act notice, the address which appears to the Commissioner to be or most recently to have been the address of the association is taken for the purposes of section 176 of the Act to have been notified to the Commissioner under section 174.

(4) An address for service lodged with the Commissioner

under section 203(1 )(b) or (2)(b) of the Act is taken for

the purposes of section 176 of the Act to have been

notified to the Commissioner under section 174. R. KENNEDY, Clerk of the Executive Council.
