AN ORDINANCE

To amend the Associations Incorporation Ordinance 1953.

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administra­ tion) Act 1910.

ASSOCIATIONS INCORPORATION (AMENDMENT)

ORDINANCE 1977

1. This Ordinance may be cited as the Associations Incorporation
(Amendment) Ordinance 1977.*

2. This Ordinance shall come into operation on 1 August 1977.

3 . In this Ordinance, "Principal Ordinance" means the Associa­ tions Incorporation Ordinance 1953.f

and N o . 60, 1976.

4 . After section 2 of the Principal Ordinance the following section is inserted:—

" 2 A . (1) There shall be paid to the Registrar—

(a) the fees specified in the Schedule; and
(b) such other fees as are prescribed.

" ( 2 ) Where a fee is payable to the Registrar for or in respect of the filing of a document with, or the giving of a document to, the Registrar, the document shall be deemed not to have been filed with, or given to, the Registrar until the fee has been paid to the Registrar.

" ( 3 ) Where a fee is payable to the Registrar for or in respect of the doing of an act by the Registrar, the Registrar is not required to do that act until the fee has been paid to the Registrar.".

5 . Section 25 of the Principal Ordinance is amended by omitting

paragraph (f) and substituting the following paragraph:—

" ( f ) prescribing fees, not exceeding $20, to be paid to the Registrar for or in respect of matters or things required to be done under, or for the purposes of, this Ordinance, being matters or things for which fees are not specified in the Schedule; and" .

6. The following Schedule is added at the end of the Principal

1. For the issue, under sub-section 6 (1 ) , of a certificate of incorporation . . 20 .00

section 5 or a document evidencing the authority of a person to make such

8. Except where the Registrar is satisfied that just cause exists for the failure to file a document before the date on which it is filed, on late filing of a document under this Ordinance, in addition to any other fee—

(a)

if filed within one month after the prescribed time, such amount, not exceeding $2.00, as the Registrar fixes;

(b)

if filed later than one month after the prescribed time, such amount, not exceeding $10.00, as the Registrar fixes.
