ASSOCIATIONS INCORPORATION ACT 1984—REGULATION

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Associations In-corporation Act 1984, has been pleased to make the Regulation set forth hereunder.

The Associations Incorporation Regulation 1994 is amended:

(a) by omitting clause 3 and by inserting instead the following clause:

Definitions

3. In this Regulation:

“Director-General” means the Director-General of the

Department of Fair Trading;

“the Act” means the Associations Incorporation Act 1984. by omitting the word “Commissioner” wherever occurring and by inserting instead the word “Director-General”;

(b)

(c) by omitting clause 5 and by inserting instead the following clause:

Forms: copy quality

5. Forms lodged with the Director-General are to be of such a standard, and are to be completed in such a manner, as to ensure that they are suitable for microfilming and electronic imaging (that is, recording electronically by means of computer scanning).

(d)

by inserting in clause 6 (1) after the words “in a form” the words “lodged with the Director-General”;

(e)

by omitting from clause 14 (2) (g) the words “within the meaning of the Act”;

(f) by omitting Schedule 2.

EXPLANATORY NOTE

The Statute Law (Miscellaneous Provisions) Act (No. 2) 1994 amended the Associations Incorporation Act 1984. The amendments included the replacement of references in that Act to “prescribed” forms with references to “approved” forms, i.e. forms approved by the Commissioner (now the Director-General of the Department of Fair Trading).

The object of this Regulation is to revise the Associations Incorporation Regulation 1994 as a consequence of the amendments, and the administrative changes, referred to above. The principal change is the omission of Schedule 2 (which contains 21 prescribed forms).

This Regulation is made under the Associations Incorporation Act 1984, particularly section 73 (1) (the general regulation-making power).
