| Alteration of other rules of organisation. |
[1] On 16 December 2013 the Association of Consulting Architects - Australia lodged
with the Fair Work Commission a notice and declaration setting out particulars of alterations
to the rules of the Association of Consulting Architects - Australia.
[2] The particulars set out alterations to Rules 3, 4, 25, 31, 44, and 49 of the rules of the Association of Consulting Architects - Australia.
[3] The alterations insert a new definition intended to avoid discrimination; enable the Association to hold general meetings by teleconference or other technological means; enable the Association to serve documents on members by electronic means; alter the closing date of the roll of voters for Branch Committee elections; clarify the dispersal of assets and liabilities upon dissolution of the Association; and insert a new object to clarify the purpose for which assets and income can be dispersed.
[4] On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.
[5] On 12 May 2014 John Stephen Kennedy, National President, gave consent under subsection 159(2) of the Fair Work (Registered Organisations) Act 2009 for the Delegate to make various amendments to the alterations for the purpose of correcting typographical, clerical or formal errors. Accordingly the following corrections have been made:
In proposed Rule 49(2), the word ‘that’ is inserted between ‘amount’ and
‘remains’.
In proposed Rule 3 - Definitions, ‘(a)’ is removed as it appears before ‘Gender’.

[6] In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise
agreements, and are not otherwise contrary to law. I certify accordingly under subsection
159(1) of the Fair Work (Registered Organisations) Act 2009.
