Alteration of other rules of organisation.

1. On 12 December 2017 the Association of Consulting Architects - Australia lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to its rules.

1. The particulars set out alterations to rule 3, 11, 12, 19 and inserts new rule 8A.The purpose of the alterations is to provide for affiliate membership; amend the process in which fees and subscriptions are paid and remitted within the organisation; allow for a second representative to sit in a non-voting capacity at National Executive Committee meetings; and to provide for a new casual vacancy rule to alleviate the need to call elections for a casual vacancy where the unexpired period of office is eighteen months or less.

1. On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.

On 30 January 2018, Paul Viney, President, gave consent, under subsection 159(2) of the Fair Work (Registered Organisations) Act 2009 (the Act), for the Delegate to make various amendments to the alterations for the purpose of correcting typographical, clerical or formal errors. Accordingly the following corrections have been made:

   ·   In proposed rule 3, the definition of ‘unfinancial member’, amend ‘month’ to ‘months’; and

   ·   In proposed sub rule 11(5), delete the word ‘be’ between the words ‘shall’ and not’ in the last sentence to read ‘shall not be disbursed’.

1. In my opinion, the alterations comply with and are not contrary to the Act, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Act.
